PAG LIN 1 1 Section 1. Section 18.3, Code 2001, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 2A. Approving and executing, in 1 4 accordance with rules adopted by the director, all sole source 1 5 contracts and all contracts with an aggregate cost exceeding 1 6 twenty thousand dollars, for the purchase of equipment, 1 7 supplies, or services, that are proposed by a state agency, 1 8 except for purchases for equipment, supplies, or services used 1 9 by the state department of transportation, institutions under 1 10 the control of the state board of regents, the department for 1 11 the blind, and any other agencies exempted by law. 1 12 "Sole source contract" means a contract for the purchase of 1 13 equipment, supplies, or services that is entered into or 1 14 proposed to be entered into by a state agency, after 1 15 soliciting and negotiating with only one source. 1 16 EXPLANATION 1 17 This bill amends Code section 18.3 by requiring the 1 18 director of the department of general services to approve and 1 19 execute all contracts for purchases of equipment, supplies, or 1 20 services by state agencies that are sole source contracts or 1 21 that have an aggregate cost exceeding $20,000. "Sole source 1 22 contract" is defined as a contract for the purchase of 1 23 equipment, supplies, or services that is solicited and 1 24 negotiated with only one source, i.e., is noncompetitive. 1 25 This requirement does not apply to purchase contracts for 1 26 equipment, supplies, or services used by the state department 1 27 of transportation, state board of regents institutions, the 1 28 department for the blind, and any other agencies exempted by 1 29 law. 1 30 LSB 1425YH 79 1 31 av/cls/14
