  1  1    Section 1.  NEW SECTION.  285.17  TRANSPORTATION FUNDING.
  1  2    Transportation services provided by a school district,
  1  3 other than for reimbursement of nonpublic school pupil
  1  4 transportation pursuant to section 285.2, shall be funded
  1  5 pursuant to the district transportation levy established in
  1  6 section 298.4A.  A school district with an average
  1  7 transportation cost exceeding the state average transportation
  1  8 cost by one hundred fifty percent shall be eligible for
  1  9 transportation assistance aid pursuant to section 257.31,
  1 10 subsection 17.
  1 11    Sec. 2.  NEW SECTION.  298.4A  DISTRICT TRANSPORTATION
  1 12 LEVY.
  1 13    1.  The board of directors of an eligible school district
  1 14 may certify for levy by April 15 of a school year, a tax on
  1 15 all taxable property in the school district for a district
  1 16 transportation levy.  A school district shall be eligible to
  1 17 levy for transportation costs if the district's average
  1 18 transportation cost exceeds one hundred seventy dollars per
  1 19 pupil.  The revenues from the tax levied in this section shall
  1 20 be placed in the district transportation levy fund of the
  1 21 school district.  District transportation levy revenues shall
  1 22 be expended for transportation costs incurred pursuant to
  1 23 chapter 285 including, but not limited to, costs for the
  1 24 following:
  1 25    a.  Transporting students.
  1 26    b.  Purchasing of transportation equipment.
  1 27    c.  Purchasing transportation services.
  1 28    d.  Leasing transportation equipment and lease-purchasing
  1 29 transportation equipment.
  1 30    2.  The amount certified for levy shall not include claims
  1 31 for reimbursement of nonpublic school pupil transportation for
  1 32 which funds are appropriated to the department of education
  1 33 pursuant to section 285.2.
  1 34    Sec. 3.  NEW SECTION.  298A.3A  DISTRICT TRANSPORTATION
  1 35 LEVY FUND.
  2  1    The district transportation levy fund is a special revenue
  2  2 fund.  A district transportation levy fund must be established
  2  3 in any school corporation which levies the tax authorized
  2  4 under section 298.4A.  
  2  5                           EXPLANATION
  2  6    This bill provides that transportation services provided by
  2  7 a school district pursuant to Code chapter 285 shall be funded
  2  8 by a district transportation levy.  The bill provides that a
  2  9 school district shall be eligible to levy for transportation
  2 10 costs if the district's average transportation cost exceeds
  2 11 $170 per pupil.  The bill provides that revenue from the levy
  2 12 shall be placed in a district transportation levy fund of the
  2 13 school district, and expended for transporting students,
  2 14 purchasing transportation equipment, purchasing transportation
  2 15 services, and leasing or lease-purchasing transportation
  2 16 equipment.  The bill provides that the amount certified for
  2 17 levy shall not include reimbursement claims for nonpublic
  2 18 school pupil transportation for which funds are appropriated
  2 19 to the department of education pursuant to Code section 285.2.
  2 20 The bill also provides that a school district with an average
  2 21 transportation cost exceeding the state average transportation
  2 22 cost by 150 percent shall remain eligible for transportation
  2 23 assistance aid pursuant to Code section 257.31, subsection 17.
