1 1 Section 1. NEW SECTION. 155A.32A REMEDIES – DISPENSING
1 2 OF INCORRECT OR INAPPROPRIATE PRESCRIPTION DRUGS.
1 3 The board of pharmacy examiners shall adopt rules pursuant
1 4 to chapter 17A to establish remedies, including but not
1 5 limited to refunds or account credits, for the dispensing of
1 6 incorrect or inappropriate prescription drugs to the ultimate
1 7 user. The rules shall specify acts or omissions that
1 8 constitute the dispensing of incorrect or inappropriate
1 9 prescription drugs which may include but are not limited to
1 10 the dispensing of a prescription drug that is not indicated by
1 11 the prescription order or medication order of the
1 12 practitioner, or the dispensing of a prescription drug that
1 13 has an adverse effect on the ultimate user.
1 14 EXPLANATION
1 15 This bill directs the board of pharmacy examiners to adopt
1 16 rules to establish remedies for the dispensing of incorrect or
1 17 inappropriate prescription drugs to the ultimate user. The
1 18 rules are to specify what constitutes the dispensing of
1 19 incorrect or inappropriate prescription drugs including
1 20 dispensing a prescription drug that is not indicated by the
1 21 prescription order or medication order or the dispensing of a
1 22 prescription drug that has an adverse effect on the ultimate
1 23 user.
