  1  1    Section 1.  Section 162.7, Code 2001, is amended to read as
  1  2 follows:
  1  3    162.7  DEALER LICENSE.
  1  4    A person shall not operate as a dealer unless the person
  1  5 department has obtained issued the person a license issued by
  1  6 the secretary or unless the person has obtained a certificate
  1  7 of registration issued by the secretary if the kennel dealer
  1  8 is federally licensed.  Application An application for the
  1  9 license or the certificate shall be made in the manner
  1 10 provided by the secretary department.  The license and or
  1 11 certificate expire expires one year from the date of issue
  1 12 unless revoked.  The license fee is one hundred dollars per
  1 13 year and the certification certificate fee is twenty dollars
  1 14 per year.  The license may be renewed upon application and
  1 15 payment of the fee in the manner provided by the secretary
  1 16 department if the licensee has conformed to all statutory and
  1 17 regulatory requirements.  The certificate may be renewed upon
  1 18 application and payment of the fee in the manner provided by
  1 19 the secretary department.  As a condition of licensure or
  1 20 certification, a commercial breeder must maintain breeding
  1 21 records as required in section 162.11A.
  1 22    Sec. 2.  Section 162.8, Code 2001, is amended to read as
  1 23 follows:
  1 24    162.8  COMMERCIAL BREEDER'S LICENSE.
  1 25    A person shall not operate as a commercial breeder unless
  1 26 the department has issued the person has obtained a license
  1 27 issued by the secretary or unless the person has obtained a
  1 28 certificate of registration issued by the secretary if the
  1 29 kennel commercial breeder is federally licensed.  Application
  1 30 The application for the license or the certificate shall be
  1 31 made in the manner provided by the secretary department.  The
  1 32 annual license or the certification period certificate expires
  1 33 one year from the date of issue.  The license fee is forty
  1 34 dollars per year and the certificate fee is twenty dollars per
  1 35 year.  The license may be renewed upon application and payment
  2  1 of the prescribed fee in the manner provided by the secretary
  2  2 department if the licensee has conformed to all statutory and
  2  3 regulatory requirements.  The certificate may be renewed upon
  2  4 application and payment of the prescribed fee in the manner
  2  5 provided by the secretary department.  As a condition of
  2  6 licensure or certification, a commercial breeder must maintain
  2  7 breeding records as required in section 162.11A.
  2  8    Sec. 3.  Section 162.11, subsection 2, Code 2001, is
  2  9 amended to read as follows:
  2 10    2.  The certificate of registration may be denied or
  2 11 revoked if the person no longer possesses a current and valid
  2 12 federal license.  Other than obtaining the certificate of
  2 13 registration from the secretary, any Except as otherwise
  2 14 provided in this chapter, a person who is a dealer or
  2 15 commercial breeder and any person or who operates a commercial
  2 16 kennel or public auction and who holds a certificate of
  2 17 registration shall not be subject to further regulation under
  2 18 the provisions of this chapter.
  2 19    Sec. 4.  NEW SECTION.  62.11A  BREEDING RECORDS.
  2 20    A person who is a commercial breeder or dealer shall
  2 21 maintain breeding records for dogs or cats that the person
  2 22 sells or offers for sale.  The records shall indicate the
  2 23 familial relationship between the dam and sire that produced
  2 24 the progeny that the person is selling or offering for sale.
  2 25 The records shall also indicate any known genetic disorder or
  2 26 disability that impairs the health of the dam or sire.  A
  2 27 person purchasing the progeny may review information about the
  2 28 dam and sire as required to be contained in the breeding
  2 29 records.
  2 30    For purposes of this section, a familial relationship is
  2 31 present if the dam and sire are related as dam and progeny,
  2 32 sire and progeny, or as littermates.
  2 33    Sec. 5. Section 162.12, Code 2001, is amended to read as
  2 34 follows:
  2 35    162.12  DENIAL OR REVOCATION OF LICENSE OR REGISTRATION.
  3  1    1.  A certificate of registration may be denied to any
  3  2 person who is a pound or animal shelter and a license or
  3  3 certificate of registration may be denied to any person who is
  3  4 a public auction, boarding kennel, commercial kennel, research
  3  5 facility, pet shop, commercial breeder, or dealer, or an
  3  6 existing certificate or license may be revoked by the
  3  7 secretary department if, after public hearing, it is
  3  8 determined that the housing any of the following apply:
  3  9    a.  Housing facilities or primary enclosures are inadequate
  3 10 under this chapter or if the rules adopted pursuant to this
  3 11 chapter.
  3 12    b.  Practices relating to the feeding, watering, cleaning,
  3 13 and or housing practices at the pound, animal shelter, public
  3 14 auction, pet shop, boarding kennel, commercial kennel,
  3 15 research facility, or those practices by the commercial
  3 16 breeder or dealer, of animals are not in compliance with this
  3 17 chapter or with the rules adopted pursuant to this chapter.
  3 18    c.  A commercial breeder or dealer fails to maintain
  3 19 breeding records as required in section 162.11A.
  3 20    2.  The premises of each licensee or certificate holder
  3 21 shall be open for inspection during normal business hours.  As
  3 22 part of the inspection, the department may access breeding
  3 23 records required to be maintained by a commercial breeder or
  3 24 dealer as provided in section 162.11A.  
  3 25                           EXPLANATION
  3 26    This bill amends Code chapter 162 that in part regulates
  3 27 commercial breeders and dealers of dogs and cats by the
  3 28 department of agriculture and land stewardship.
  3 29    The bill requires that a commercial breeder or dealer
  3 30 maintain breeding records for dogs or cats that the person
  3 31 sells or offers for sale.  The records must indicate the
  3 32 familial relationship between the dam and sire that produced
  3 33 the progeny that the person is selling or offering for sale.
  3 34 The records must also indicate any known genetic disorder or
  3 35 disability that impairs the health of the dam or sire.  The
  4  1 bill provides that a person purchasing the progeny may review
  4  2 information about the progeny's dam and sire as required to be
  4  3 contained in the breeding records.
  4  4    The bill provides that a license issued by the department
  4  5 or certificate or registration (if federally licensed) is
  4  6 conditioned on maintaining the breeding records.
