1 1 Section 1. Section 321.34, subsection 16, Code 2001, is
1 2 amended to read as follows:
1 3 16. NATIONAL GUARD SPECIAL PLATES. An owner referred to
1 4 in subsection 12 who is a member of the national guard, as
1 5 defined in chapter 29A, may, upon written application to the
1 6 department, order special registration plates with a national
1 7 guard processed emblem with the emblem designed by the
1 8 department in cooperation with the adjutant general which
1 9 emblem signifies that the applicant is a member of the
1 10 national guard. The application shall be approved by the
1 11 department in consultation with the adjutant general. Special
1 12 registration plates with a national guard processed emblem
1 13 shall be surrendered, as provided in subsection 12, in
1 14 exchange for regular registration plates upon termination of
1 15 the owner's membership in the active national guard. The fees
1 16 collected by the director for special plates issued under this
1 17 subsection shall be paid monthly to the treasurer of state and
1 18 credited to the road use tax fund. Notwithstanding section
1 19 423.24, and prior to the crediting of revenues to the road use
1 20 tax fund under section 423.24, subsection 1, paragraph "b",
1 21 the treasurer of state shall credit monthly an amount of use
1 22 tax revenues equal to the amount of the special fees collected
1 23 in the previous month for the national guard special plates to
1 24 the college student aid commission. The moneys received by
1 25 the college student aid commission are appropriated for
1 26 purposes of the national guard educational assistance program
1 27 under section 261.86.
1 28 EXPLANATION
1 29 This bill requires that an amount of use tax revenues equal
1 30 to the special fees collected for national guard special motor
1 31 vehicle registration plates be credited to the college student
1 32 aid commission for purposes of the national guard educational
1 33 assistance program. Currently, such use tax revenues are
1 34 credited to the road use tax fund.
