1 1 Section 1. Section 321.324A, subsection 1, Code 2001, is
1 2 amended to read as follows:
1 3 1. For purposes of this section, "funeral procession"
1 4 means a procession of motor vehicles accompanying the body of
1 5 a deceased person during daylight hours which is being
1 6 escorted by a vehicle equipped with and displaying a flashing
1 7 purple light pursuant to section 321.423, or by a vehicle
1 8 continually displaying its emergency signal lamps flashing
1 9 simultaneously and using lighted head lamps and identifying
1 10 flags, and keeping all other motor vehicles with lighted head
1 11 lamps in close formation.
1 12 Sec. 2. Section 321.423, subsection 2, Code 2001, is
1 13 amended by adding the following new paragraph:
1 14 NEW PARAGRAPH. h. A flashing purple light on a vehicle
1 15 upon which a purple light is permitted pursuant to subsection
1 16 8.
1 17 Sec. 3. Section 321.423, Code 2001, is amended by adding
1 18 the following new subsection:
1 19 NEW SUBSECTION. 8. FLASHING PURPLE LIGHT. A flashing
1 20 purple light may be used as a dome light mounted on the roof
1 21 of a vehicle owned by a funeral establishment licensed under
1 22 chapter 156 or a vehicle owned by a private funeral escort
1 23 company in the following circumstances:
1 24 a. The vehicle is authorized by the director of public
1 25 health. The director of public health shall give such
1 26 authorization when all of the following apply:
1 27 (1) The request for authorization is made by the licensed
1 28 funeral establishment or private funeral escort company on
1 29 forms provided by the Iowa department of public health.
1 30 (2) The licensed funeral establishment provides proof of
1 31 licensure or the private funeral escort company attests to the
1 32 nature of the company's business.
1 33 The Iowa department of public health shall adopt rules to
1 34 establish issuance standards and certificate of authorization
1 35 revocation procedures.
2 1 b. The vehicle is escorting a funeral procession pursuant
2 2 to section 321.324A.
2 3 EXPLANATION
2 4 This bill allows a licensed funeral establishment or
2 5 private funeral escort company, upon receiving a certificate
2 6 of authorization from the Iowa department of public health, to
2 7 use a flashing purple dome light when escorting a funeral
2 8 procession.
