1 1 Section 1. NEW SECTION. 483A.28 REGISTRATION OF HUNTING
1 2 LEASE OUTFITTERS – PENALTY.
1 3 1. A person shall not engage in or be employed for any
1 4 compensation in the business of a hunting lease outfitter in
1 5 this state unless the person is registered as a hunting lease
1 6 outfitter with the department. The commission shall define,
1 7 by rule, the activities that constitute hunting lease
1 8 outfitter activities for the purposes of this section. The
1 9 rules shall require an applicant for registration to identify
1 10 the location and acreage to be hunted and the equipment and
1 11 services to be provided by the outfitter.
1 12 2. The commission shall establish, by rule, the annual fee
1 13 for a hunting lease outfitter registration required pursuant
1 14 to this section. In determining an annual fee, the commission
1 15 shall consider the costs of providing for the registration and
1 16 administering and enforcing the provisions of this section.
1 17 3. A violation of this section or the rules adopted
1 18 pursuant to this section is a simple misdemeanor and is
1 19 punishable as provided in section 483A.42.
1 20 EXPLANATION
1 21 This bill provides for the registration of persons engaged
1 22 in the business of hunting lease outfitter. The department of
1 23 natural resources is directed to define what activities
1 24 constitute hunting lease outfitter activities and register
1 25 hunting lease outfitters upon application and payment of an
1 26 annual fee determined by rule of the natural resource
1 27 committee. An applicant shall identify the location and
1 28 acreage to be hunted and the equipment and services to be
1 29 provided by the outfitter.
1 30 A violator is guilty of a simple misdemeanor and subject to
1 31 a scheduled fine of $100 for each offense.
