1 1 Section 1. APPROPRIATION. There is appropriated from the
1 2 general fund of the state to the department of education for
1 3 the fiscal year beginning July 1, 2001, and ending June 30,
1 4 2002, the following amount, or so much thereof as is
1 5 necessary, to be used for the purpose designated:
1 6 For deposit in the teacher compensation reform and student
1 7 achievement savings account fund created in section 12.90:

1 9 Sec. 2. NEW SECTION. 12.90 TEACHER COMPENSATION REFORM
1 10 AND STUDENT ACHIEVEMENT SAVINGS ACCOUNT FUND.
1 11 1. A teacher compensation reform and student achievement
1 12 savings account fund is created and established as a separate
1 13 and distinct fund in the state treasury under the control of
1 14 the department of education. Moneys in the fund in a fiscal
1 15 year shall be used as directed by the general assembly for
1 16 teacher compensation reform and student achievement activities
1 17 approved by the Seventy-ninth General Assembly, 2001 Regular
1 18 Session, or by future general assemblies.
1 19 2. Revenue for the teacher compensation reform and student
1 20 achievement savings account fund shall be deposited with the
1 21 treasurer of state and credited to the fund and shall include,
1 22 but is not limited to, moneys in the form of a devise, gift,
1 23 bequest, donation, federal or other grant, reimbursement,
1 24 repayment, judgment, transfer, payment, or appropriation from
1 25 any source intended to be used for the purposes of the fund.
1 26 3. Moneys in the teacher compensation reform and student
1 27 achievement savings account fund are not subject to section
1 28 8.33.
1 29 EXPLANATION
1 30 This bill makes a supplemental appropriation of $40 million
1 31 from the general fund of the state to the department of
1 32 education for the 2001-2002 fiscal year for deposit in the
1 33 teacher compensation reform and student achievement savings
1 34 account fund, which the bill establishes in statute.
1 35 The fund is established in the state treasury under the
2 1 control of the department of education. The fund shall be
2 2 used for teacher compensation reform and student achievement
2 3 activities established by the 2001 regular session of the
2 4 general assembly or by future general assemblies.
2 5 Moneys in the fund shall not revert to the general fund at
2 6 the end of a fiscal year.
