  1  1    Section 1.  Section 260C.22, subsection 1, paragraph a,
  1  2 Code 2001, is amended to read as follows:
  1  3    a.  In addition to the tax authorized under section
  1  4 260C.17, the voters in any merged area may at the annual
  1  5 school election vote a tax not exceeding twenty and one-fourth
  1  6 forty and one-half cents per thousand dollars of assessed
  1  7 value in any one year for a period not to exceed ten years for
  1  8 the purchase of grounds, construction of buildings, payment of
  1  9 debts contracted for the construction of buildings, purchase
  1 10 of buildings and equipment for buildings, and the acquisition
  1 11 of libraries, for the purpose of paying costs of utilities,
  1 12 and for the purpose of maintaining, remodeling, improving, or
  1 13 expanding the community college of the merged area.  If the
  1 14 tax levy is approved under this section, the costs of
  1 15 utilities shall be paid from the proceeds of the levy.  The
  1 16 tax shall be collected by the county treasurers and remitted
  1 17 to the treasurer of the merged area as provided in section
  1 18 331.552, subsection 29.  The proceeds of the tax shall be
  1 19 deposited in a separate and distinct fund to be known as the
  1 20 voted tax fund, to be paid out upon warrants drawn by the
  1 21 president and secretary of the board of directors of the
  1 22 merged area district for the payment of costs incurred in
  1 23 providing the school facilities for which the tax was voted.
  1 24    Sec. 2.  APPLICABILITY.  This Act applies to property taxes
  1 25 due and payable for fiscal years beginning on or after July 1,
  1 26 2002.  
  1 27                              EXPLANATION
  1 28    This bill increases the community college facilities levy
  1 29 from 20 1/4 cents to 40 1/2 cents per thousand dollars of
  1 30 assessed value.  Proceeds of the levy may be used for the
  1 31 purchase of grounds or buildings, construction of buildings,
  1 32 payment of debt issued for construction of buildings, purchase
  1 33 of equipment for buildings, the acquisition of libraries, for
  1 34 paying the costs of utilities, and for otherwise maintaining,
  1 35 remodeling, improving, or expanding the community college.
  2  1    Under current law, the 20 1/4 cent levy is subject to
  2  2 approval by the voters.  The bill provides that the 40 1/2
  2  3 cent levy will be subject to approval by the voters.
  2  4    The bill applies to property taxes due and payable for
  2  5 fiscal years beginning on or after July 1, 2002.
