PAG LIN 1 1 Section 1. Section 455E.11, subsection 2, paragraph a, 1 2 subparagraph (1), subparagraph subdivision (c), Code 2001, is 1 3 amended to read as follows: 1 4 (c) Twenty-five cents shall be retained by the sanitary 1 5 landfill operator for purposes of collecting household 1 6 hazardous waste at regional collection centers. If a solid 1 7 waste agency is not providing or partnering with another 1 8 agency to provide household hazardous waste collection, the 1 9 twenty-five cents from that area shall be retained by the 1 10 department to assist with household hazardous waste disposal 1 11 education. 1 12 (d) Provided local match moneys are available, seventy- 1 13 five cents shall be retained by the sanitary landfill operator 1 14 in accordance with section 455B.310 and shall be used only for 1 15 any of the following: 1 16 (i) Curbside or drop-off recycling programs. 1 17 (ii) Yardwaste programs. 1 18 (iii) White goods recycling programs. For purposes of 1 19 this subparagraph subdivision part, "white goods" means a 1 20 major household appliance including a refrigerator, stove, 1 21 oven, deep freeze freezer, dishwasher, clothes washer, clothes 1 22 dryer, or microwave oven. 1 23 (iv) Household hazardous waste programs. 1 24 (v) Brown goods recycling programs. For purposes of this 1 25 subparagraph subdivision part, "brown goods" means household 1 26 or commercial electronic equipment. 1 27 (vi) Public awareness programs related to solid waste 1 28 management and recycling. 1 29 (vii) School education programs related to solid waste 1 30 management and recycling. 1 31 (e) The remaining funds shall be used by the department to 1 32 develop and implement demonstration projects for landfill 1 33 alternatives to solid waste disposal including recycling 1 34 programs. 1 35 Sec. 2. Section 455E.11, subsection 2, paragraph a, 2 1 subparagraph (2), subparagraph subdivision (f), Code 2001, is 2 2 amended to read as follows: 2 3 (f) Eight and one-half percent to the department to 2 4 provide additional toxic cleanup days or other efforts of the 2 5 department to support permanent household hazardous material 2 6 collection systems and special events for household hazardous 2 7 material collection, and for the natural resource geographic2 8information system required under section 455E.8, subsection2 96. Departmental rules adopted for implementation of toxic 2 10 cleanup days shall provide sufficient flexibility to respond 2 11 to the household hazardous material collection needs of both 2 12 small and large communities. Repayment of moneys from the 2 13 Iowa business loan program for waste reduction and recycling 2 14 pursuant to section 455B.310, subsection 2, paragraph "b", 2 15 Code 1993, and discontinued pursuant to 1993 Iowa Acts, 2 16 chapter 176, section 45, shall be placed into this account to 2 17 support household hazardous materials programs of the 2 18 department. 2 19 EXPLANATION 2 20 This bill amends allocations of the solid waste account of 2 21 the groundwater protection fund. 2 22 The bill provides that, out of every $1.75 of the $4.75 2 23 tonnage fee, 75 cents shall be retained by the sanitary 2 24 landfill operator for purposes of collecting household 2 25 hazardous waste at regional collection centers. The bill also 2 26 provides that, if local match moneys are available, 75 cents 2 27 of the tonnage fee shall be retained by the sanitary landfill 2 28 operator for purposes including curbside or drop-off recycling 2 29 programs, yardwaste programs, white goods recycling programs, 2 30 household hazardous waste programs, brown goods recycling 2 31 programs, public awareness programs, and school education 2 32 programs. 2 33 The bill eliminates the natural resource geographic 2 34 information system as a purpose for which moneys from the 2 35 solid waste account may be used. 3 1 LSB 2005HH 79 3 2 tm/cls/14
