  1  1    Section 1.  Section 708.2A, subsection 2, paragraph b, Code
  1  2 2001, is amended to read as follows:
  1  3    b.  A serious misdemeanor, if the under any of the
  1  4 following:
  1  5    (1)  The domestic abuse assault causes bodily injury or
  1  6 mental illness.
  1  7    (2)  The domestic abuse assault is committed on the home
  1  8 premises of the person who commits the assault or of the
  1  9 victim of the assault, when a child, who is in the care,
  1 10 custody, or control of the person who commits the assault or
  1 11 of the victim of the assault, is present on the premises.
  1 12    (3)  The domestic abuse assault is committed within the
  1 13 visual or physical proximity of a child who is in the care,
  1 14 custody, or control of the person who commits the assault or
  1 15 of the victim of the assault.  
  1 16                           EXPLANATION
  1 17    This bill establishes domestic abuse assault penalties for
  1 18 certain assaults committed in the presence or proximity of a
  1 19 child.
  1 20    The bill provides that on a first offense of domestic abuse
  1 21 assault, as defined in Code section 708.1, a person commits a
  1 22 serious misdemeanor if the domestic abuse assault is committed
  1 23 on the person's or the victim of the assault's home premises
  1 24 where a child, under the supervision of the person or the
  1 25 victim of the assault, is present, or the domestic abuse
  1 26 assault is committed by a person within the visual or physical
  1 27 proximity of a child under the supervision of the person or
  1 28 the victim of the assault.
  1 29    A serious misdemeanor is punishable by confinement for no
  1 30 more than one year and a fine of at least $250 but not more
  1 31 than $1,500.
