  1  1    Section 1.  Section 321.285, subsections 2 and 3, Code
  1  2 2001, are amended to read as follows:
  1  3    2.  Twenty-five miles per hour in any residence or school
  1  4 district.  Each school district, as defined in section 321.1,
  1  5 shall be marked by distinctive signs as provided by the
  1  6 current manual of uniform traffic control devices adopted by
  1  7 the department and placed on the road at the limits of the
  1  8 school district.  Each sign shall inform motorists that the
  1  9 scheduled fine for committing a moving traffic violation in a
  1 10 school district is doubled.
  1 11    3.  Forty-five miles per hour in any suburban district.
  1 12 Each school district as defined in subsection 70 of section
  1 13 321.1 shall be marked by distinctive signs as provided by the
  1 14 current manual of uniform traffic control devices adopted by
  1 15 the department and placed on the highway at the limits of such
  1 16 school district.
  1 17    Sec. 2.  Section 805.8, subsection 2A, Code 2001, is
  1 18 amended to read as follows:
  1 19    2A.  MOVING TRAFFIC VIOLATIONS – ROAD WORK ZONES AND
  1 20 SCHOOL DISTRICTS.  The scheduled fine for any moving traffic
  1 21 violations under chapter 321 as provided in this section shall
  1 22 be doubled if the violation occurs within any road work zone
  1 23 or school district, as defined in section 321.1.
  1 24    Sec. 3.  IMPLEMENTATION OF ACT.  Section 25B.2, subsection
  1 25 3, shall not apply to this Act.  
  1 26                           EXPLANATION 
  1 27    This bill provides that the scheduled fine for any moving
  1 28 traffic violation shall be doubled if the violation occurs
  1 29 within any school district, as defined in Code section 321.1.
  1 30 Code section 321.1 defines a school district as the territory
  1 31 contiguous to and including a highway for a distance of 200
  1 32 feet in either direction from a schoolhouse in a city.  The
  1 33 bill requires that the signs marking the limits of a school
  1 34 district inform motorists of such doubling of fines.
  1 35    The bill also moves a provision relating to the posting of
  2  1 the school district signs from one place in Code section
  2  2 321.285 to another place in that Code section relating to the
  2  3 speed limit in school districts.  The governmental entity
  2  4 having jurisdiction over the road is responsible for posting
  2  5 the signs.
  2  6    The bill may include a state mandate as defined in Code
  2  7 section 25B.3.  The bill makes inapplicable Code section
  2  8 25B.2, subsection 3, which would relieve a political
  2  9 subdivision from complying with a state mandate if funding for
  2 10 the cost of the state mandate is not provided or specified.
  2 11 Therefore, political subdivisions are required to comply with
  2 12 any state mandate included in the bill.
