  1  1    Section 1.  Section 20.9, Code 2001, is amended to read as
  1  2 follows:
  1  3    20.9  SCOPE OF NEGOTIATIONS.
  1  4    1.  The public employer and the employee organization shall
  1  5 meet at reasonable times, including meetings reasonably in
  1  6 advance of the public employer's budget-making process, to
  1  7 negotiate in good faith with respect to wages, hours,
  1  8 vacations, insurance, holidays, leaves of absence, shift
  1  9 differentials, overtime compensation, supplemental pay,
  1 10 seniority, transfer procedures, job classifications, health
  1 11 and safety matters, evaluation procedures, procedures for
  1 12 staff reduction, in-service training and other all matters
  1 13 mutually agreed upon, and all of the following issues:
  1 14    a.  Wages.
  1 15    b.  Hours.
  1 16    c.  Vacations.
  1 17    d.  Insurance, including health insurance benefits for
  1 18 retirees.
  1 19    e.  Holidays.
  1 20    f.  Leaves of absence.
  1 21    g.  Shift differentials.
  1 22    h.  Overtime compensation.
  1 23    i.  Supplemental pay.
  1 24    j.  Seniority.
  1 25    k.  Transfer procedures.
  1 26    l.  Job classifications.
  1 27    m.  Health and safety matters.
  1 28    n.  Evaluation procedures.
  1 29    o.  Procedures for staff reduction.
  1 30    p.  In-service training.  Negotiations shall also include
  1 31 terms
  1 32    q.  Terms authorizing dues checkoff for members of the
  1 33 employee organization and grievance.
  1 34    r.  Grievance procedures for resolving any questions
  1 35 arising under the agreement, which.
  2  1    2.  The agreement of the parties shall be embodied in a
  2  2 written agreement and signed by the parties.
  2  3    3.  If an agreement provides for dues checkoff, a member's
  2  4 dues may be checked off only upon the member's written request
  2  5 and the member may terminate the dues checkoff at any time by
  2  6 giving thirty days' written notice.  Such
  2  7    4.  The obligation to negotiate in good faith under this
  2  8 section does not compel either party to agree to a proposal or
  2  9 make a concession.
  2 10    5.  Nothing in this section shall diminish the authority
  2 11 and power of the department of personnel, board of regents'
  2 12 merit system, Iowa public broadcasting board's merit system,
  2 13 or any civil service commission established by constitutional
  2 14 provision, statute, charter, or special act to recruit
  2 15 employees, prepare, conduct, and grade examinations, rate
  2 16 candidates in order of their relative scores for certification
  2 17 for appointment or promotion or for other matters of
  2 18 classification, reclassification, or appeal rights in the
  2 19 classified service of the public employer served.
  2 20    6.  All retirement systems shall be excluded from the scope
  2 21 of negotiations.  For the purposes of this section,
  2 22 "retirement systems" includes only the systems providing
  2 23 retirement payments pursuant to chapters 97, 97A, 97B, 410,
  2 24 411, and 412, and to sections 602.1611, 602.11115, and
  2 25 602.11116, and does not include health insurance benefits for
  2 26 retirees mandated as a subject of negotiations by subsection
  2 27 1, paragraph "d".  
  2 28                           EXPLANATION 
  2 29    This bill amends the mandatory subjects of bargaining for
  2 30 public employees under Code section 20.9.  The bill also
  2 31 reorganizes the existing Code language.
  2 32    The bill specifies that insurance benefits for retirees are
  2 33 included within the general topic of insurance as a mandatory
  2 34 subject of bargaining for public employees.  The other
  2 35 mandatory subjects of bargaining remain the same, but are now
  3  1 placed in individually lettered subsections.
  3  2    The bill provides that the specification of insurance
  3  3 benefits for retirees as a mandatory subject of bargaining
  3  4 under subsection 1 does not violate the exclusion from
  3  5 negotiations in subsection 6 of retirement systems, by
  3  6 defining retirement systems to include only retirement
  3  7 payments made pursuant to the systems in certain chapters and
  3  8 sections of the Code, and to specifically exclude health
  3  9 insurance benefits for retirees.
