1 1 Section 1. Section 455B.203, subsection 3, paragraph a,
1 2 Code 2001, is amended to read as follows:
1 3 a. Calculations necessary to determine the land area
1 4 required for the application of manure from a confinement
1 5 feeding operation. The calculations shall be based on
1 6 nitrogen and phosphorus use levels in order to obtain optimum
1 7 crop yields according to a crop schedule specified in the
1 8 plan, and according to requirements adopted by the department
1 9 after receiving recommendations from the animal agriculture
1 10 consulting organization provided for in 1995 Iowa Acts,
1 11 chapter 195, section 37.
1 12 EXPLANATION
1 13 This bill amends Code section 455B.203, which provides
1 14 requirements for manure management plans submitted by owners
1 15 of confinement feeding operations or persons applying manure
1 16 originating from confinement feeding operations. The Code
1 17 section provides that the plan must include calculations
1 18 necessary to determine the amount of land needed for the
1 19 application of the manure. The calculations are based on
1 20 nitrogen use levels needed to obtain optimum crop yields.
1 21 This bill provides that the calculations must also be based on
1 22 phosphorus use levels. Generally, a person submitting a
1 23 manure management plan who is found in violation of the terms
1 24 and conditions of the plan is subject to a civil penalty of
1 25 not more than $5,000.
