PAG LIN 1 1 Section 1. NEW SECTION. 56.14A POLITICAL TELEPHONE 1 2 COMMUNICATION LIMITATIONS. 1 3 1. A person shall not make an unsolicited telephone call 1 4 relating to the nomination or election of a candidate for 1 5 public office in Iowa, or to the passage or defeat of a ballot 1 6 issue in Iowa, that is made for purposes of conducting a poll, 1 7 conducting research, or sharing information, unless the person 1 8 making the telephone call discloses all of the following 1 9 information at the commencement of the call: 1 10 a. The person's name. 1 11 b. The purpose of the telephone call. 1 12 c. The name of any individual, business, or organization 1 13 on whose behalf the call is being made. 1 14 d. The identity of any person or group who has directly or 1 15 indirectly paid for the making of the telephone call. 1 16 e. The location from which the telephone call is being 1 17 made. 1 18 2. Notwithstanding section 56.16, a person who violates 1 19 the requirements of this section shall pay, in the manner 1 20 prescribed by the board, a civil penalty of five hundred 1 21 dollars for each telephone call made in violation of this 1 22 section. Moneys from civil penalties collected under this 1 23 section shall be disposed of in the same manner as other civil 1 24 penalties collected under section 68B.32D. 1 25 3. The board shall adopt rules pursuant to chapter 17A 1 26 establishing procedures to administer this section. 1 27 EXPLANATION 1 28 This bill requires persons conducting, via unsolicited 1 29 telephone calls, political research or polls, or sharing 1 30 information relating to candidates or constitutional or public 1 31 measures, to disclose certain information. The information 1 32 which must be disclosed includes the person's name, the 1 33 purpose of the telephone call, the name of any individual or 1 34 business on whose behalf the call is being made, the identity 1 35 of any person or group who has directly or indirectly paid for 2 1 the making of the telephone call, and the location from which 2 2 the telephone call is being made. Failure to abide by the 2 3 requirements of the section will subject the person to a $500 2 4 civil penalty for each telephone call made. The new 2 5 requirements are to be enforced by the ethics and campaign 2 6 disclosure board and any moneys collected are to be disposed 2 7 of in the same manner as other civil penalties collected by 2 8 that board.
