1 1 Section 1. Section 135C.14, Code 2001, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 9. Rest periods for all personnel, in
1 4 addition to any other rest or meal periods otherwise required.
1 5 The rest periods shall be as follows:
1 6 a. At least two rest periods of fifteen minutes each
1 7 during each work period of eight consecutive hours.
1 8 b. At least one rest period of fifteen minutes during each
1 9 work period of at least two but not more than eight
1 10 consecutive hours.
1 11 EXPLANATION
1 12 This bill provides that rules adopted by the department of
1 13 inspections and appeals establishing minimum standards for
1 14 health care facilities are to include specified rest periods
1 15 for all personnel. The rest periods specified are: at least
1 16 two rest periods of 15 minutes each during each work period of
1 17 eight consecutive hours and at least one rest period of 15
1 18 minutes during each work period of at least two but not more
1 19 than eight consecutive hours. Existing provisions relating to
1 20 denial, suspension, or revocation of a health care facility
1 21 license based upon failure to comply with rules or minimum
1 22 standards adopted under the chapter would apply to a health
1 23 care facility's failure to comply with the rest periods
1 24 requirements.
