  1  1    Section 1.  Section 257.14, subsection 1, Code 2001, is
  1  2 amended to read as follows:
  1  3    1.  For the budget year commencing July 1, 2000 2001, if
  1  4 the department of management determines that the regular
  1  5 program district cost of a school district for a budget year
  1  6 is less than the total of the regular program district cost
  1  7 plus any adjustment added under this section for the base year
  1  8 for that school district, the school district shall be
  1  9 eligible to receive a budget adjustment for that district for
  1 10 that budget year up to an amount equal to the difference.  The
  1 11 board of directors of a school district that wishes to receive
  1 12 a budget adjustment pursuant to this subsection shall,
  1 13 notwithstanding the public notice and hearing provisions of
  1 14 chapter 24 or any other provision to the contrary, within
  1 15 thirty days following April 6, 2000 the enactment of this Act,
  1 16 adopt a resolution to receive the budget adjustment and
  1 17 immediately notify the department of management of the
  1 18 adoption of the resolution and the amount of the budget
  1 19 adjustment to be received.
  1 20    Sec. 2.  Section 257.14, subsection 2, Code 2001, is
  1 21 amended by striking the subsection and inserting in lieu
  1 22 thereof the following:
  1 23    2.  For the budget year commencing July 1, 2002, if the
  1 24 department of management determines that the regular program
  1 25 district cost of a school district for a budget year is less
  1 26 than the regular program district cost for the base year for
  1 27 that school district, the school district shall be eligible to
  1 28 receive a budget adjustment for that district for that budget
  1 29 year up to an amount equal to the difference.  The board of
  1 30 directors of a school district that wishes to receive a budget
  1 31 adjustment pursuant to this subsection shall adopt a
  1 32 resolution to receive the budget adjustment and notify the
  1 33 department of management of the adoption of the resolution and
  1 34 the amount of the budget adjustment to be received by March 1,
  1 35 2002.
  2  1    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  2  2 immediate importance, takes effect upon enactment.  
  2  3                           EXPLANATION
  2  4    This bill extends the budget guarantee provision, currently
  2  5 applicable to school districts pursuant to Code section
  2  6 257.14, to apply for the school budget years commencing July
  2  7 1, 2001, and July 1, 2002.  The bill provides that for the
  2  8 school budget year beginning July 1, 2001, a school district
  2  9 shall be eligible to receive a budget adjustment if the
  2 10 regular program district cost for that budget year is less
  2 11 than the regular program district cost for the base year plus
  2 12 any adjustment made under Code section 257.14 for the base
  2 13 year.  The bill provides that for the school budget year
  2 14 commencing July 1, 2002, a school district shall be eligible
  2 15 to receive a budget adjustment if the regular program district
  2 16 cost for the budget year is less than the regular program
  2 17 district cost for the base year, without reference to any
  2 18 adjustment made under Code section 257.14 for the base year.
  2 19 The bill provides dates by which a school board adopting a
  2 20 resolution to receive a budget adjustment for the school
  2 21 budget years beginning July 1, 2001, and July 1, 2002, shall
  2 22 notify the department of management of the adoption of the
  2 23 resolution and the amount of the budget adjustment to be
  2 24 received.
  2 25    The bill takes effect upon enactment.
