1 1 Section 1. NEW SECTION. 321.384A HEADLAMPS REQUIRED AT
1 2 CERTAIN SPEEDS.
1 3 A motor vehicle operated upon a highway in this state shall
1 4 display lighted headlamps as provided in section 321.415
1 5 anytime the motor vehicle is traveling at a speed of thirty-
1 6 five miles per hour or more.
1 7 Sec. 2. Section 805.8, subsection 2, paragraph e, Code
1 8 2001, is amended to read as follows:
1 9 e. For improperly used or nonused or defective or improper
1 10 equipment under sections 321.383, 321.384, 321.384A, 321.385,
1 11 321.386, 321.398, 321.402, 321.403, 321.404, 321.409, 321.419,
1 12 321.420, 321.423, 321.430, and 321.433, the scheduled fine is
1 13 twenty dollars. For violations of sections 321.247 and
1 14 321.421, the scheduled fine is one hundred dollars.
1 15 Sec. 3. WARNING CITATIONS. During the first six months
1 16 following the effective date of this Act, peace officers shall
1 17 issue only warning citations for a motor vehicle not
1 18 displaying lighted headlamps when the motor vehicle is
1 19 traveling at a speed of thirty-five miles per hour or more as
1 20 required by section 321.384A.
1 21 EXPLANATION
1 22 This bill creates new Code section 321.384A to require a
1 23 motor vehicle to display lighted headlamps anytime the motor
1 24 vehicle is traveling at a speed of 35 miles per hour or more.
1 25 A violation of the requirement is a simple misdemeanor
1 26 punishable by a scheduled fine of $20 under Code section
1 27 805.8. The bill also provides that during the first six
1 28 months following enactment, violations of the requirement will
1 29 only result in warning citations.
