  2 18    Sec. ___.  Section 455G.3, Code Supplement 2001, is
  2 19 amended by adding the following new subsections:
  2 20    NEW SUBSECTION.  7.  There is appropriated from the
  2 21 funds administered by the board to the following funds
  2 22 for the fiscal year beginning July 1, 2002, and ending
  2 23 June 30, 2003, the following amounts as specified:  
  2 24    a.  To the rebuild Iowa infrastructure fund:
  2 25 .................................................. $  9,370,600
  2 26    b.  To the environment first fund:  
  2 27 .................................................. $  9,500,000
  2 28    c.  To the general fund of the state:  
  2 29 .................................................. $ 17,903,369
  2 30    This subsection is repealed effective July 1, 2004.
  2 31    NEW SUBSECTION.  8.  Notwithstanding other
  2 32 limitations of this chapter, the board may transfer
  2 33 moneys without limitation between the different
  2 34 accounts and funds authorized by this chapter as
  2 35 determined by the board and to fulfill the purposes of
  2 36 this chapter.  This subsection is repealed effective
  2 37 July 1, 2004.
  2 38    Sec. ___.  Section 455G.6, Code 2001, is amended by
  2 39 adding the following new subsection:
  2 40    NEW SUBSECTION.  17.  Not later than October 31,
  2 41 2002, the board shall enter into a loss portfolio
  2 42 transfer agreement, to be implemented not later than
  2 43 December 31, 2002, with the restructured insurance
  2 44 board authorized in section 455G.11, subsection 1,
  2 45 paragraph "c", for the payment of claims for
  2 46 corrective action associated with releases at sites
  2 47 which are insured at the time of the transfer by the
  2 48 restructured insurance board subject to the following
  2 49 conditions:
  2 50    a.  The value of the transfer shall be determined
  3  1 by mutual agreement of persons representing the board,
  3  2 the restructured insurance board authorized in section
  3  3 455G.11, subsection 1, paragraph "c", and a third
  3  4 party designated and agreed to by the board and the
  3  5 restructured insurance board.  The amount transferred
  3  6 shall be adequate to address all claim costs for
  3  7 corrective action, fees, taxes, risk costs incurred by
  3  8 the transferee, administration expenses associated
  3  9 with the transferred claims, and other costs as
  3 10 mutually agreed to by the parties.
  3 11    b.  The transfer shall address payments to eligible
  3 12 claimants as determined by the board prior to the
  3 13 transfer.
  3 14    c.  The transfer shall coincide with the transfer
  3 15 of liabilities subject to the following, unless the
  3 16 parties mutually agree otherwise:
  3 17    (1)  The lesser of twenty-five percent of the
  3 18 agreed upon value or twenty million dollars, to be
  3 19 transferred at the time of implementation of the
  3 20 agreement, but not later than December 31, 2002,
  3 21 unless another date is mutually agreed to by the
  3 22 parties.
  3 23    (2)  Fifty percent of the remaining amount to be
  3 24 transferred by July 1, 2003.
  3 25    (3)  Any remaining amount to be transferred by July
  3 26 1, 2004.
  3 27    d.  The transferee shall be responsible for all
  3 28 claim costs for corrective action, fees, and taxes
  3 29 associated with each claim transferred.
  3 30    e.  Claims for releases at sites that are not
  3 31 insured by the transferee may be included in the
  3 32 agreement entered into pursuant to this subsection or
  3 33 subsequent agreements if agreed to by the board and
  3 34 the restructured insurance board.
  3 35    Sec.    .  EFFECTIVE DATE.  This division of this
  3 36 Act takes effect July 1, 2002."
