Notwithstanding section 8.33, moneys 4 17 appropriated in this section that remain unencumbered 4 18 or unobligated at the close of the fiscal year shall 4 19 not revert but shall remain available for expenditure 4 20 for the purposes designated until the close of the 4 21 succeeding fiscal year. The provisions of section 4 22 8.39 do not apply to the moneys appropriated in this 4 23 section. 4 24 Sec. . PREMIUM TAX REVENUES. Notwithstanding 4 25 any provision of law to the contrary, if 2002 Iowa 4 26 Acts, Senate File 2318, is enacted, before any premium 4 27 tax revenues are credited to the general fund of the 4 28 state for the fiscal year beginning July 1, 2002, and 4 29 ending June 30, 2003, the following amount of the 4 30 revenues first received is appropriated to the 4 31 department of education for the fiscal year beginning 4 32 July 1, 2002, and ending June 30, 2003, to be used for 4 33 the purposes designated: 4 34 For purposes, as provided in law, of the student 4 35 achievement and teacher quality program established 4 36 pursuant to chapter 284: 4 37 .................................................. $ 10,000,000 4 38 Notwithstanding section 8.33, moneys appropriated 4 39 in this section that remain unencumbered or 4 40 unobligated at the close of the fiscal year shall not 4 41 revert but shall remain available for expenditure for 4 42 the purposes designated until the close of the 4 43 succeeding fiscal year. Notwithstanding section 8.57, 4 48 subsection 5, there is transferred from pari-mutuel 4 49 wagering and gambling revenues credited to the rebuild 4 50 Iowa infrastructure fund created in section 8.57, 5 1 subsection 5, for public vertical infrastructure 5 2 projects, to the department of education for the 5 3 fiscal year beginning July 1, 2002, and ending June 5 4 30, 2003, the following amount, to be used for the 5 5 purposes designated: 5 6 For purposes, as provided in law, of the student 5 7 achievement and teacher quality program established 5 8 pursuant to chapter 284: 5 9 .................................................. $ 5,000,000 5 10 Moneys transferred in this section are appropriated 5 11 to the department to be used for the purposes 5 12 designated.
