PAG LIN 1 1 Amend House File 2623 as follows: 1 2 #1. Page 17, by inserting after line 16, the 1 3 following: 1 4 "Sec. . NEW SECTION. 249A.21 INTERMEDIATE 1 5 CARE FACILITIES FOR PERSONS WITH MENTAL RETARDATION 1 6 ASSESSMENT. 1 7 1. The department may assess intermediate care 1 8 facilities for persons with mental retardation, as 1 9 defined in section 135C.1, that are not operated by 1 10 the state, a fee in an amount not to exceed six 1 11 percent of the total annual revenue of the facility 1 12 for the preceding fiscal year. Counties shall not be 1 13 required to participate in the cost of the assessment. 1 14 2. The assessment shall be paid to the department 1 15 in equal monthly amounts on or before the fifteenth 1 16 day of each month. The department may deduct the 1 17 monthly amount from medical assistance payments to a 1 18 facility described in subsection 1. The amount 1 19 deducted from payments shall not exceed the total 1 20 amount of the assessments due. 1 21 3. Revenue from the assessments shall be credited 1 22 to the state medical assistance appropriation. This 1 23 revenue may be used only for services for which 1 24 federal financial participation under the medical 1 25 assistance program is available to match state funds. 1 26 4. If federal financial participation to match the 1 27 assessments made under subsection 1 becomes 1 28 unavailable under federal law, the department shall 1 29 terminate the imposing of the assessments beginning on 1 30 the date that the federal statutory, regulatory, or 1 31 interpretive change takes effect. 1 32 5. The department of human services may procure a 1 33 sole source contract to implement the provisions of 1 34 this section." 1 35 #2. Page 27, by inserting after line 11, the 1 36 following: 1 37 "Sec. . 2002 Iowa Acts, House File 2326, 1 38 section 93, subsection 2, unnumbered paragraph 1, if 1 39 enacted, is amended to read as follows: 1 40 2. IOWA VETERANS HOME 1 41 For salaries, support, maintenance, miscellaneous 1 42 purposes, and for not more than the following full- 1 43 time equivalent positions: 1 44 ..................................................$ 14,445,6941 45 $ 14,937,583 1 46 Sec. . 2002 Iowa Acts, House File 2326, section 1 47 106, if enacted, is amended by adding the following 1 48 new subsection: 1 49 NEW SUBSECTION. 3. Moneys received in excess of 1 50 $491,899 pursuant to section 249A.21, if enacted by 2 1 the Seventy-ninth General Assembly, 2002 Session, 2 2 shall be used to supplement the appropriation for the 2 3 hawk-i program in this section and in any other Act." 2 4 #3. Page 32, by inserting after line 14, the 2 5 following: 2 6 "Sec. . EFFECTIVE DATE.
