1 3 #1. Page 7, by striking lines 17 through 32, and
1 4 inserting the following:
1 5 "Sec. . DEPARTMENT OF CORRECTIONS SPECIAL
1 6 NEEDS UNIT. There is appropriated from the healthy
1 7 Iowans tobacco trust created in section 12.65, to the
1 8 department of corrections for the fiscal year
1 9 beginning July 1, 2002, and ending June 30, 2003, the
1 10 following amount, or so much thereof as is necessary,
1 11 to be used for the purpose designated:
1 12 For operating the special needs unit at the Fort
1 13 Madison correctional facility and for not more than
1 14 the following full-time equivalent positions:
1 15 .................................................. $ 1,100,000
1 16 ................................................ FTEs 17.87"
1 17 #2. By striking page 7, line 33, through page 8,
1 18 line 11, and inserting the following:
1 19 "Sec.___. PRIOR YEAR NONREVERSION.
1 20 Notwithstanding 2001 Iowa Acts, chapter 184, section
1 21 3, subsection 3, 2001 Iowa Acts, chapter 184, section
1 22 13, and section 8.33, moneys appropriated under 2001
1 23 Iowa Acts, chapter 184, section 3, subsection 2, for
1 24 the establishment and operating of a substance abuse
1 25 treatment facility which are unobligated or
1 26 unencumbered on April 1, 2002, shall not be expended
1 27 or obligated during the remainder of the fiscal year
1 28 beginning July 1, 2001, and ending June 30, 2002, and
1 29 shall not revert but shall be available for the fiscal
1 30 year beginning July 1, 2002, and ending June 30, 2003,
1 31 for the following:
1 32 1. The first $200,000 available shall be used for
1 33 a value-based treatment program at the Newton
1 34 correctional facility.
1 35 2. The remaining moneys available shall be used to
1 36 supplement the appropriations in this or any other Act
1 37 for substance abuse treatment under the substance
1 38 abuse treatment program.
1 39 3. Any unobligated or unencumbered moneys
1 40 remaining at the end of the fiscal year beginning July
1 41 1, 2002, shall revert to the healthy Iowans tobacco
1 42 trust."
1 43 #3. Page 10, by striking lines 3 through 7.
1 44 #4. Page 10, by inserting after line 11, the
1 45 following:
1 46 "Sec. . EFFECTIVE DATE RETROACTIVE
1 47 APPLICABILITY. Section 6 of this Act, relating to
1 48 nonexpenditure, nonobligation, and nonreversion of
1 49 funds remaining unencumbered or unobligated on April
1 50 1, 2002, which were appropriated for the establishment
2 1 and operation of a substance abuse treatment facility
2 2 and which are to be available in the fiscal year
2 3 beginning July 1, 2002, and ending June 30, 2003, to
2 4 supplement appropriations for substance abuse
2 5 treatment under the substance abuse treatment program,
2 6 takes effect upon enactment and is retroactively
2 7 applicable to April 1, 2002."
2 8 #5. Title page, by striking line 3, and inserting
2 9 the following: "and providing effective dates, and
2 10 providing for retroactive applicability."
