1 5 "Sec. . NEW SECTION. 72.7 PUBLIC WORKS
1 6 PROJECTS – COMPETITIVE BIDDING REQUIREMENTS.
1 7 Prior to awarding a contract to perform work on a
1 8 public works project pursuant to a competitive bidding
1 9 procedure, which contract authorizes the expenditure
1 10 of twenty-five thousand dollars or more in public
1 11 funds, a public owner as defined in section 72.6 shall
1 12 consider, in determining whether a bidder is
1 13 responsible, the bidder's record of reliability and
1 14 timely completion of past projects, the qualifications
1 15 of the bidder and its employer and subcontractors to
1 16 properly perform the type of work required by the
1 17 contract, and the past experience of the bidder and
1 18 its subcontractors on projects of the same or similar
1 19 nature. In addition, for a bid to be considered a
1 20 responsible bid, the bidder and its subcontractors
1 21 shall possess a documented record of reliability and
1 22 timely completion of past projects of the same or
1 23 similar scope of work and a sufficient number of
1 24 qualified and trained employees to properly perform
1 25 the type and nature of work required under the
1 26 contract. Proof of a sufficient number of qualified
1 27 and trained employees shall not be required if the
1 28 bidder and its subcontractors can establish its
1 29 payment of the prevailing wage for the work to be
1 30 performed as determined by the department of workforce
1 31 development based upon wage determinations established
1 32 by the United States department of labor for similar
1 33 work pursuant to 29 C.F.R. } 1.5 and 29 C.F.R. }
1 34 1.6(b)."
1 35 #2. Title page, line 2, by inserting after the
1 36 word "projects" the following: "and providing for
1 37 certain competitive bidding procedures for public
1 38 owners".
1 39 #3. By renumbering, redesignating, and correcting
1 40 internal references as necessary.
