  1  2 follows:
  1  3    #1.  Page 61, by inserting after line 22, the
  1  4 following:
  1  5    "Funds appropriated in this lettered paragraph
  1  6 shall not be used for the purposes of human cloning as
  1  7 defined in section 707B.3.  However, this prohibition
  1  8 shall not be interpreted to prohibit the use of these
  1  9 funds for areas of scientific research not
  1 10 specifically prohibited as provided in section 707B.4,
  1 11 subsection 2."

  1 13 following:

  1 33    Sec.    .  NEW SECTION.  707B.1  TITLE.
  1 34    This chapter shall be known and may be cited as the
  1 35 "Human Cloning Prohibition Act".
  1 36    Sec.    .  NEW SECTION.  707B.2  PURPOSE.
  1 37    It is the purpose of this chapter to prohibit human
  1 38 cloning for any purpose, whether for reproductive
  1 39 cloning or therapeutic cloning.
  1 40    Sec.    .  NEW SECTION.  707B.3  DEFINITIONS.
  1 41    As used in this chapter, unless the context
  1 42 otherwise requires:
  1 43    1.  "Destructive research" means medical,
  1 44 scientific, or laboratory research, or other kinds of
  1 45 investigation that destroy or injure the subject of
  1 46 the research.  "Research" means a systematic
  1 47 investigation, including research development,
  1 48 testing, and evaluation, designed to develop or
  1 49 contribute to generalizable knowledge.  "Destructive
  1 50 research" does not include in vitro fertilization and
  2  1 accompanying embryo transfer to a woman's body or any
  2  2 diagnostic test that may assist in the future care of
  2  3 the woman.
  2  4    2.  "Fetus" means a living organism of the species
  2  5 homo sapiens from eight weeks' development until
  2  6 complete expulsion or extraction from a woman's body,
  2  7 or until removal from an artificial womb or other
  2  8 similar environment designed to nurture the
  2  9 development of such organism.
  2 10    3.  "Human cloning" means human asexual
  2 11 reproduction, accomplished by introducing the genetic
  2 12 material of a human somatic cell into a fertilized or
  2 13 unfertilized oocyte whose nucleus has been removed or
  2 14 inactivated, to produce a living organism with a human
  2 15 or predominantly human genetic constitution.
  2 16    4.  "Human embryo" means a living organism of the
  2 17 species homo sapiens from the single-celled stage to
  2 18 eight weeks' development.
  2 19    5.  "Human somatic cell" means a cell having a
  2 20 complete set of chromosomes obtained from a living or
  2 21 deceased human organism of the species homo sapiens at
  2 22 any stage of development.
  2 23    6.  "Oocyte" means the unfertilized human ovum.
  2 24    Sec.    .  NEW SECTION.  707B.4  HUMAN CLONING –
  2 25 PROHIBITIONS – EXCEPTIONS – PENALTY.
  2 26    1.  A person shall not intentionally or knowingly
  2 27 do any of the following:
  2 28    a.  Perform or attempt to perform human cloning.
  2 29    b.  Participate in performing or in an attempt to
  2 30 perform human cloning.
  2 31    c.  Transfer or receive a cloned human embryo for
  2 32 any purpose.
  2 33    d.  Transfer or receive, in whole or in part, any
  2 34 oocyte, human embryo, fetus, or human somatic cell,
  2 35 for the purpose of human cloning.
  2 36    e.  Conduct destructive research on a cloned human
  2 37 embryo.
  2 38    2.  This section shall not restrict areas of
  2 39 scientific research not specifically prohibited,
  2 40 including in vitro fertilization; the administration
  2 41 of fertility-enhancing drugs; or research in the use
  2 42 of nuclear transfer or other cloning techniques to
  2 43 produce molecules, deoxyribonucleic acid, tissues,
  2 44 organs, plants, animals other than humans, or cells
  2 45 other than human embryos.
  2 46    3.  a.  A person who violates subsection 1,
  2 47 paragraph "a" or "b", is guilty of a class "C" felony.
  2 48    b.  A person who violates subsection 1, paragraph
  2 49 "c", "d", or "e" is guilty of an aggravated
  2 50 misdemeanor.
  3  1    4.  A person who violates this section in a manner
  3  2 that results in a pecuniary gain to the person is
  3  3 subject to a civil penalty in an amount that is twice
  3  4 the amount of the gross gain.
  3  5    5.  A person who violates this section and who is
  3  6 licensed pursuant to chapter 148, 150, or 150A is
  3  7 subject to revocation of the person's license.
  3  8    6.  A violation of this section is grounds for
  3  9 denial of an application for, denial of renewal of, or
  3 10 revocation of any license, permit, certification, or
  3 11 any other form of permission required to practice or
  3 12 engage in any trade, occupation, or profession
  3 13 regulated by the state.
  3 14    Sec.    .  NEW SECTION.  707B.5  HUMAN CLONING –
  3 15 USE OF GENERAL FUND OF THE STATE – PROHIBITION –
  3 16 CIVIL PENALTY.
  3 17    1.  A person shall not use moneys from the general
  3 18 fund of the state for the purposes of human cloning.
  3 19    2.  This section shall not prohibit the use of
  3 20 moneys from the general fund of the state for areas of
  3 21 scientific research not specifically prohibited as
  3 22 provided in section 707B.4, subsection 2.
  3 23    3.  A person who violates this section is subject
  3 24 to a civil penalty in the amount of the expenditure of
  3 25 moneys from the general fund of the state used in
  3 26 violation of this section."
  3 27    #5.  Title page, line 3, by inserting after the
  3 28 word "dates" the following:  "and providing
  3 29 penalties".
