  1  1    Amend the amendment, H-8471, to House File 2090 as
  1  2 follows:
  1  3    #1.  Page 1, line 5, by striking the words "PROJECT
  1  4 LABOR AGREEMENTS PROHIBITED –".
  1  5    #2.  Page 1, by striking lines 7 through 24 and
  1  6 inserting the following:
  1  7    "#   .  Page 2, by striking lines 2 through 24 and
  1  8 inserting the following:
  1  9    "   .  CONTRACTING PROCEDURES.
  1 10    a.  In the award of a contract which authorizes the
  1 11 expenditure of twenty-five thousand dollars or more in
  1 12 public funds for a public works project pursuant to a
  1 13 competitive bidding procedure, a public contracting
  1 14 entity shall consider, in determining whether a bidder
  1 15 is responsible, the bidder's record of reliability and
  1 16 timely completion of past projects, the qualifications
  1 17 of the bidder and its employer and subcontractors to
  1 18 properly perform the type of work required by the
  1 19 contract, and the past experience of the bidder and
  1 20 its subcontractors on projects of the same or similar
  1 21 nature.  In addition, for a bid to be considered a
  1 22 responsible bid, the bidder and its subcontractors
  1 23 shall possess a documented record of reliability and
  1 24 timely completion of past projects of the same or
  1 25 similar scope of work and a sufficient number of
  1 26 qualified and trained employees to properly perform
  1 27 the type and nature of work required under the
  1 28 contract.  Proof of a sufficient number of qualified
  1 29 and trained employees shall not be required if the
  1 30 bidder and its subcontractors can establish its
  1 31 payment of the prevailing wage for the work to be
  1 32 performed as determined by the department of workforce
  1 33 development based upon wage determinations established
  1 34 by the United States department of labor for similar
  1 35 work pursuant to 29 C.F.R. } 1.5 and 29 C.F.R. }
  1 36 1.6(b).""

  1 38 inserting the following:
