  1  1    Amend the amendment, H-8422, to Senate File 2228,
  1  2 as passed by the Senate, as follows:
  1  3    #1.  Page 1, by inserting after line 2 the
  1  4 following:
  1  5    "#   .  Page 1, by inserting before line 1 the
  1  6 following:
  1  7    "Sec.    .  Section 8.57, subsection 5, paragraph
  1  8 c, Code Supplement 2001, is amended to read as
  1  9 follows:
  1 10    c.  Moneys in the fund in a fiscal year shall be
  1 11 used as directed by the general assembly for public
  1 12 vertical infrastructure projects and for the student
  1 13 achievement and teacher quality program established in
  1 14 chapter 284.  For the purposes of this subsection,
  1 15 "vertical infrastructure" includes only land
  1 16 acquisition and construction, major renovation and
  1 17 major repair of buildings, all appurtenant structures,
  1 18 utilities, site development, and recreational trails.
  1 19 "Vertical infrastructure" does not include routine,
  1 20 recurring maintenance or operational expenses or
  1 21 leasing of a building, appurtenant structure, or
  1 22 utility without a lease-purchase agreement.  However,
  1 23 appropriations may be made for the fiscal years
  1 24 beginning July 1, 1997, and July 1, 1998, for the
  1 25 purpose of funding the completion of Part III of the
  1 26 Iowa communications network.""

  1 28 "electorate," the following:  "utilization of rebuild
  1 29 Iowa infrastructure fund for purposes of teacher
  1 30 pay,".
