1 3 #1. Page 1, by inserting before line 1 the
1 4 following:
1 5 "Section 1. Section 711.3, Code 2001, is amended
1 6 to read as follows:
1 7 711.3 ROBBERY IN THE SECOND DEGREE.
1 8 All robbery which is not robbery in the first
1 9 degree is robbery in the second degree, except as
1 10 provided in section 711.3A. Robbery in the second
1 11 degree is a class "C" felony.
1 12 Sec. 2. NEW SECTION. 711.3A ROBBERY IN THE THIRD
1 13 DEGREE.
1 14 A person commits robbery in the third degree when,
1 15 while perpetrating a robbery, the person does not do
1 16 any of the following: cause injury, attempt to cause
1 17 injury, threaten to cause injury or to commit a
1 18 forcible felony, purposefully put another in fear of
1 19 injury, possess a firearm or dangerous weapon, commit
1 20 a theft of cash or an item with a value greater than
1 21 fifty dollars, or commit a robbery of a financial
1 22 institution as defined in section 12C.1. Robbery in
1 23 the third degree is a class "D" felony."
1 24 #2. Page 1, by inserting after line 8, the
1 25 following:
1 26 "Sec. . 2001 Iowa Acts, chapter 186, section 6,
1 27 subsection 6, is amended by striking the subsection.
1 28 Sec. . EFFECTIVE DATE. The section of this Act
1 29 amending 2001 Iowa Acts, chapter 186, section 6,
1 30 subsection 6, being deemed of immediate importance,
1 31 takes effect upon enactment."
1 32 #3. Title page, by striking lines 1 and 2, and
1 33 inserting the following: "An Act relating to criminal
1 34 offenses and procedure, including the criminal offense
1 35 of robbery, drug courts, and the filing of a criminal
1 36 indictment or trial information, and providing for an
1 37 effective date."
1 38 #4. By renumbering as necessary.
