  1  1    Amend Senate File 2192, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 18, by inserting after line 26, the
  1  4 following:
  1  5    "Sec.    .  Section 322.2, subsection 7, Code
  1  6 Supplement 2001, is amended to read as follows:
  1  7    7.  "Engaged in the business" means doing any of
  1  8 the following acts for the purpose of the sale of
  1  9 motor vehicles at retail:  acquiring, selling,
  1 10 exchanging, holding, offering, displaying, brokering,
  1 11 accepting on consignment, conducting a retail auction,
  1 12 or acting as an agent for the purpose of doing any of
  1 13 those acts.  A person selling at retail more than six
  1 14 motor vehicles during a twelve-month period may be
  1 15 presumed to be engaged in the business, except that a
  1 16 private, nonprofit corporation chartered under chapter
  1 17 504A shall not be presumed to be engaged in the
  1 18 business of selling used vehicles, provided that the
  1 19 vehicles sold by the private, nonprofit corporation
  1 20 are vehicles that have been donated to the private,
  1 21 nonprofit corporation for the purpose of raising funds
  1 22 for the private, nonprofit corporation.  A private,
  1 23 nonprofit corporation that sells more that twenty-five
  1 24 vehicles in a twelve-month period shall, however, be
  1 25 required to be licensed under this chapter as an
  1 26 entity engaged in the business of selling motor
  1 27 vehicles."
  1 28    #2.  By renumbering, redesignating, and correcting
  1 29 internal references as necessary.
