  1  1    Amend House File 2547 as follows:
  1  2    #1.  Page 2, by striking lines 9 through 17 and
  1  3 inserting the following:
  1  4    "Sec.    .  Section 135.24, Code Supplement 2001,
  1  5 is amended to read as follows:
  1  6    135.24  VOLUNTEER HEALTH CARE PROVIDER PROGRAM
  1  7 ESTABLISHED – IMMUNITY FROM CIVIL LIABILITY.
  1  8    1.  The director shall establish within the
  1  9 department a program to provide to eligible hospitals,
  1 10 clinics, or other health care facilities, health care
  1 11 referral programs, or charitable organizations, free
  1 12 medical, and dental, and chiropractic services given
  1 13 on a voluntary basis by health care providers.  A
  1 14 participating health care provider shall register with
  1 15 the department and obtain from the department a list
  1 16 of eligible, participating hospitals, clinics, or
  1 17 other health care facilities, health care referral
  1 18 programs, or charitable organizations.
  1 19    2.  The department, in consultation with the
  1 20 department of human services, shall adopt rules to
  1 21 implement the volunteer health care provider program
  1 22 which shall include the following:
  1 23    a.  Procedures for registration of health care
  1 24 providers deemed qualified by the board of medical
  1 25 examiners, the board of physician assistant examiners,
  1 26 the board of dental examiners, and the board of
  1 27 nursing, and the board of chiropractic examiners.
  1 28    b.  Criteria for and identification of hospitals,
  1 29 clinics, or other health care facilities, health care
  1 30 referral programs, or charitable organizations,
  1 31 eligible to participate in the provision of free
  1 32 medical, or dental, or chiropractic services through
  1 33 the volunteer health care provider program.  A health
  1 34 care facility, a health care referral program, a
  1 35 charitable organization, or a health care provider
  1 36 participating in the program shall not bill or charge
  1 37 a patient for any health care provider service
  1 38 provided under the volunteer health care provider
  1 39 program.
  1 40    c.  Identification of the medical services to be
  1 41 provided under the program.  The medical services
  1 42 provided may include, but shall not be limited to,
  1 43 obstetrical and gynecological medical services, and
  1 44 psychiatric services provided by a physician licensed
  1 45 under chapter 148, 150, or 150A, or services provided
  1 46 under chapter 151.
  1 47    3.  A health care provider providing free care
  1 48 under this section shall be considered an employee of
  1 49 the state under chapter 669 and shall be afforded
  1 50 protection as an employee of the state under section
  2  1 669.21, provided that the health care provider has
  2  2 done all of the following:
  2  3    a.  Registered with the department pursuant to
  2  4 subsection 1.
  2  5    b.  Provided medical, or dental, or chiropractic
  2  6 services through a hospital, clinic, or other health
  2  7 care facility, health care referral program, or
  2  8 charitable organization listed as eligible and
  2  9 participating by the department pursuant to subsection
  2 10 1.
  2 11    4.  For the purposes of this section, "charitable
  2 12 organization" means a charitable organization within
  2 13 the meaning of section 501(c)(3) of the Internal
  2 14 Revenue Code which has as its primary purpose the
  2 15 sponsorship or support of programs designed to improve
  2 16 the quality, awareness, and availability of
  2 17 chiropractic, dental, or medical or dental services to
  2 18 children and to serve as a funding mechanism for
  2 19 provision of chiropractic, dental, or medical or
  2 20 dental services, including but not limited to
  2 21 immunizations, to children in this state.
  2 22    5.  For the purposes of this section, "health care
  2 23 provider" means a physician licensed under chapter
  2 24 148, 150, or 150A, or 151, a physician assistant
  2 25 licensed and practicing under a supervising physician
  2 26 pursuant to chapter 148C, a licensed practical nurse,
  2 27 a registered nurse, or a dentist, dental hygienist, or
  2 28 dental assistant registered or licensed to practice
  2 29 under chapter 153."
