PAG LIN 1 1 Amend the amendment, H-8210, to Senate File 429, as 1 2 amended, passed, and reprinted by the Senate, as 1 3 follows: 1 4 #1. Page 1, by inserting after line 4 the 1 5 following: 1 6 ""Sec. . Section 476.44, subsection 2, Code 1 7 2001, is amended to read as follows: 1 8 2. a. An electric utility subject to this 1 9 division, except a utilitywhichthat elects rate 1 10 regulation pursuant to section 476.1A, shall not be 1 11 required to purchase, at any one time, more than its 1 12 scheduled percentage share ofone hundred five1 13megawatts of powerits Iowa retail load from 1 14 alternative energy production facilities or small 1 15 hydro facilities at the rates established pursuant to 1 16 section 476.43. The board shallallocate the one1 17hundred five megawattsmake the allocations based upon 1 18 each utility's percentage of the total Iowa retail 1 19 peak demand, fortheeach year, beginning January 1, 1 201990,of all utilities subject to this section, based 1 21 on the following schedule: 1 22 (1) Until January 1, 2010, two percent. 1 23 (2) Beginning January 1, 2010, ten percent. 1 24 (3) Beginning January 1, 2020, twenty percent. 1 25 b. If a utility undergoes reorganization as 1 26 defined in section 476.76, the board shall combine the 1 27 allocated purchases of power for each utility involved 1 28 in the reorganization. 1 29 c. Notwithstanding theone hundred five megawatt1 30 current applicable maximum, the board may increase the 1 31 amount of power that a utility is required to purchase 1 32 at the rates established pursuant to section 476.43 if 1 33 the board finds that a utility, including a 1 34 reorganized utility, exceedsits 1990the Iowa retail 1 35 peak demand level for the utility for the prior year 1 36 by twenty percent and the additional power the utility 1 37 is required to purchase will encourage the development 1 38 of alternate energy production facilities and small 1 39 hydro facilities. The increase shall not exceed the 1 40 utility's increase in peak demand multiplied by the 1 41 ratio of the utility's share of theone hundred five1 42megawattcurrent scheduled maximum to its1990Iowa 1 43 retail peak demand." 1 44 #2.
