1 2 #1. By striking everything after the enacting
1 3 clause and inserting the following:
1 4 "Section 1. NEW SECTION. 72.7 PUBLIC WORKS
1 5 PROJECTS – COMPETITIVE BIDDING REQUIREMENTS.
1 6 Prior to awarding a contract to perform work on a
1 7 public works project pursuant to a competitive bidding
1 8 procedure, a public contracting entity shall consider,
1 9 in determining whether a bidder is responsible, the
1 10 bidder's record of reliability and timely completion
1 11 of past projects, the qualifications of the bidder and
1 12 its employer and subcontractors to properly perform
1 13 the type of work required by the contract, and the
1 14 past experience of the bidder and its subcontractors
1 15 on projects of the same or similar nature. In
1 16 addition, for a bid to be considered a responsible
1 17 bid, the bidder and its subcontractors shall possess a
1 18 documented record of reliability and timely completion
1 19 of past projects of the same or similar scope of work
1 20 and a sufficient number of qualified and trained
1 21 employees to properly perform the type and nature of
1 22 work required under the contract. Proof of a
1 23 sufficient number of qualified and trained employees
1 24 shall not be required if the bidder and its
1 25 subcontractors can establish its payment of the
1 26 prevailing wage for the work to be performed as
1 27 determined by the department of workforce development
1 28 based upon wage determinations established by the
1 29 United States department of labor for similar work
1 30 pursuant to 29 C.F.R. } 1.5 and 29 C.F.R. } 1.6(b)."
