  1  1    Amend House File 2456 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Sec.    .  Section 256.12, subsection 2,
  1  5 unnumbered paragraph 1, Code 2001, is amended to read
  1  6 as follows:
  1  7    This section does not deprive the respective boards
  1  8 of public school districts of any of their legal
  1  9 powers, statutory or otherwise, and in accepting the
  1 10 specially enrolled students, each of the boards shall
  1 11 prescribe the terms of the special enrollment,
  1 12 including but not limited to scheduling of courses and
  1 13 the length of class periods.  In addition, the board
  1 14 of the affected public school district shall be given
  1 15 notice by the department of its decision to permit the
  1 16 special enrollment not later than six months prior to
  1 17 the opening of the affected public school district's
  1 18 school year, except that the board of the public
  1 19 school district may waive the notice requirement.
  1 20 School districts and area education agency boards
  1 21 shall make public school services, which shall include
  1 22 special education programs and services and may
  1 23 include health services, services for remedial
  1 24 education programs, guidance services, and school
  1 25 testing services, available to children attending
  1 26 nonpublic schools in the same manner and to the same
  1 27 extent that they are provided to public school
  1 28 students.  However, services that are made available
  1 29 shall be provided on neutral sites, or in mobile units
  1 30 located off the nonpublic school premises as
  1 31 determined by the boards of the school districts and
  1 32 area education agencies providing the services, and
  1 33 not on nonpublic school property, except for health
  1 34 services, services funded by Title I of the federal
  1 35 Elementary and Secondary Education Act of 1965,
  1 36 diagnostic services for speech, hearing, and
  1 37 psychological purposes, and assistance with physical
  1 38 and communication needs of students with physical
  1 39 disabilities, and services of an educational
  1 40 interpreter, which may be provided on nonpublic school
  1 41 premises, with the permission of the lawful
  1 42 custodian."
  1 43    #2.  Title page, line 7, by inserting after the
  1 44 word "calculations," the following:  "public school
  1 45 services provided to nonpublic school pupils,".
  1 46    #3.  By renumbering as necessary.
