  1  1    Amend House File 2075 as follows:
  1  2    #1.  Page 1, line 7, by striking the word "general"
  1  3 and inserting the following:  "general children
  1  4 first".
  1  5    #2.  Page 1, line 14, by striking the words
  1  6 "general fund of the state" and inserting the
  1  7 following:  "children first fund".
  1  8    #3.  Page 1, by inserting after line 21, the
  1  9 following:
  1 10    "Sec.    .  NEW SECTION.  8.57B  CHILDREN FIRST
  1 11 FUND.
  1 12    1.  A children first fund is created in the state
  1 13 treasury.  The children first fund shall be separate
  1 14 from the general fund of the state and shall not be
  1 15 considered part of the general fund of the state
  1 16 except in determining the cash position of the state
  1 17 for payment of state obligations.  The moneys in the
  1 18 children first fund are not subject to section 8.33
  1 19 and shall not be transferred, used, obligated,
  1 20 appropriated, or otherwise encumbered except as
  1 21 provided in this section.  Moneys in the children
  1 22 first fund may be used for cash flow purposes provided
  1 23 that any moneys so allocated are returned to the
  1 24 children first fund by the end of each fiscal year.
  1 25 However, the children first fund shall be considered a
  1 26 special account for the purposes of section 8.53.
  1 27    2.  Notwithstanding section 12C.7, subsection 2,
  1 28 interest or earnings on moneys deposited in the
  1 29 children first fund shall be credited to the children
  1 30 first fund.  Interest or earnings on the moneys
  1 31 deposited in the fund are subject to appropriation for
  1 32 purposes of enhancing preschool and early education
  1 33 programs for young children.  An appropriation of any
  1 34 other moneys deposited in or credited to the fund
  1 35 shall not be made unless the bill or joint resolution
  1 36 is passed by a vote of at least three-fifths of the
  1 37 members of each house of the general assembly and is
  1 38 approved by the governor."
  1 39    #4.  Title page, line 4, by inserting after the
  1 40 word "program" the following:  "and creating a
  1 41 children first fund to which excess moneys in the
  1 42 economic emergency fund are to be transferred".
