Notwithstanding section 284.4, subsection 2, 1 6 effective July 1, 2004, teacher performance shall be 1 7 reviewed annually for purposes of assisting the 1 8 teacher in making continuous improvement. The annual 1 9 review shall be conducted by a certified evaluator who 1 10 shall be selected by an administrator after 1 11 consultation with the teacher. School districts are 1 12 encouraged to make available time for and to utilize 1 13 peer review and peer coaching techniques when 1 14 conducting the annual review. The annual review need 1 15 not be conducted if the teacher has been 1 16 comprehensively reviewed during the same school year. 1 17 The". 1 18 #2. Section 294A.14, unnumbered paragraphs 1 23 3 and 4, Code 2001, are amended to read as follows: 1 24 A plan shall be developed using the procedure 1 25 specified under section 294A.15. The plan shall 1 26 provide for the establishment of a performance-based 1 27 pay plan, a supplemental pay plan, a combination of 1 28 the two pay plans, or comprehensive school 1 29 transformation programs, and shall include a budget 1 30 for the cost of implementing the plan. In addition to 1 31 the costs of providing additional salary for teachers 1 32 and the amount required to pay the employers' share of 1 33 the federal social security and Iowa public employees' 1 34 retirement system, or a pension and annuity retirement 1 35 system established under chapter 294, and payments on 1 36 the additional salary, the budget may include costs 1 37 associated with providing specialized or general 1 38 training. Moneys received under phase III shall not 1 39 be used to employ additional employees of a school 1 40 district, except that phase III moneys may be used to 1 41 employ substitute teachers, part-time teachers, and 1 42 other employees needed to implement plans that provide 1 43 innovative staffing patterns, orthatrequire that a 1 44 teacher employed on a full-time basis be absent from 1 45 the classroom for specified periods for fulfilling 1 46 other instructional duties or to participate on a peer 1 47 review team or in peer coaching efforts. However, all 1 48 teachers employed are eligible to receive additional 1 49 salary under an approved plan. 1 50 For the purpose of this section, a performance- 2 1 based pay plan shall provide for salary increases for 2 2 teachers who demonstrate superior performance in 2 3 completing assigned duties. The plan shall include 2 4 the method used to determine superior performance of a 2 5 teacher. For school districts, the plan may include 2 6 assessments ofspecificteachingbehaviorperformance, 2 7 assessments of student performance, assessments of 2 8 other characteristics associated with effective 2 9 teaching, or a combination of these criteria." 2 10 #4.
