1 2 #1. Page 9, by inserting after line 20, the
1 3 following:
1 4 "Sec. . Section 8.57, Code 2001, is amended by
1 5 adding the following new subsection:
1 6 NEW SUBSECTION. 6. a. A volunteer fire fighters
1 7 and emergency responders fund is created under the
1 8 authority of the department of management. The fund
1 9 shall consist of appropriations made to the fund and
1 10 transfers of interest, earnings, and moneys from other
1 11 funds as provided by law. The fund shall be separate
1 12 from the general fund of the state and the balance in
1 13 the fund shall not be considered part of the balance
1 14 of the general fund of the state. However, the fund
1 15 shall be considered a special account for the purposes
1 16 of section 8.53, relating to generally accepted
1 17 accounting principles.
1 18 b. Moneys in the volunteer fire fighters and
1 19 emergency responders fund are not subject to section
1 20 8.33. Notwithstanding section 12C.7, subsection 2,
1 21 interest or earnings on moneys in the fund shall be
1 22 credited to the fund.
1 23 c. Moneys in the volunteer fire fighters and
1 24 emergency responders fund in a fiscal year shall be
1 25 used for all of the following:
1 26 (1) To provide pensions for qualified volunteer
1 27 fire fighters and volunteer emergency response
1 28 personnel.
1 29 (2) To offset the costs of an income tax credit or
1 30 deduction for volunteer fire fighters and volunteer
1 31 emergency response personnel.
1 32 (3) To provide training and equipment to local
1 33 volunteer fire departments and volunteer emergency
1 34 responders.
1 35 The state fire service and emergency response
1 36 council shall prepare a plan for expenditure of the
1 37 moneys deposited in the fund. Moneys in the fund are
1 38 subject to appropriation by the general assembly.
1 39 d. For the fiscal year beginning July 1, 2002, and
1 40 for each fiscal year thereafter, not more than the
1 41 amount of premium tax receipts collected pursuant to
1 42 section 432.1, subsection 2, in the fiscal year
1 43 beginning July 1, 2001, shall be deposited in the
1 44 general fund of the state. The total premium tax
1 45 receipt moneys in excess of the moneys deposited in
1 46 the general fund of the state in a fiscal year shall
1 47 be deposited in the volunteer fire fighters and
1 48 emergency responders fund and shall be used as
1 49 provided in this subsection.
1 50 Sec. . Section 8.58, Code 2001, is amended to
2 1 read as follows:
2 2 8.58 EXEMPTION FROM AUTOMATIC APPLICATION.
2 3 To the extent that moneys appropriated under
2 4 section 8.57 do not result in moneys being credited to
2 5 the general fund under section 8.55, subsection 2,
2 6 moneys appropriated under section 8.57 and moneys
2 7 contained in the cash reserve fund, rebuild Iowa
2 8 infrastructure fund, environment first fund, volunteer
2 9 fire fighters and emergency responders fund, and Iowa
2 10 economic emergency fund shall not be considered in the
2 11 application of any formula, index, or other statutory
2 12 triggering mechanism which would affect
2 13 appropriations, payments, or taxation rates, contrary
2 14 provisions of the Code notwithstanding.
2 15 To the extent that moneys appropriated under
2 16 section 8.57 do not result in moneys being credited to
2 17 the general fund under section 8.55, subsection 2,
2 18 moneys appropriated under section 8.57 and moneys
2 19 contained in the cash reserve fund, rebuild Iowa
2 20 infrastructure fund, environment first fund, volunteer
2 21 fire fighters and emergency responders fund, and Iowa
2 22 economic emergency fund shall not be considered by an
2 23 arbitrator or in negotiations under chapter 20.
2 24 Sec. . Section 100B.2, Code 2001, is amended by
2 25 adding the following new subsection:
2 26 NEW SUBSECTION. 9. Prepare a plan for expenditure
2 27 of moneys from the volunteer fire fighter and
2 28 emergency responders fund created in section 8.57."
