1 2 reprinted by the Senate, as follows:
1 3 #1. Page 1, by striking lines 22 through 26 and
1 4 inserting the following:
1 5 "2. Prior to entering into an agreement with a
1 6 selected private investor regarding the construction
1 7 of a school facility and a lease-purchase arrangement,
1 8 a school board shall hold a public hearing on the
1 9 question of entering into the agreement. The board
1 10 shall set forth its proposal in a resolution and shall
1 11 publish the notice of the time and place of a public
1 12 hearing on the resolution. Notice of the time and
1 13 place of the public hearing shall be published not
1 14 less than thirty days before the public hearing in a
1 15 newspaper which is a newspaper of general circulation
1 16 in the school district. At the hearing, or no later
1 17 than thirty days after the date of the hearing, the
1 18 board shall take action to adopt a resolution to
1 19 direct the county commissioner of elections to submit
1 20 the question of entering into the agreement to the
1 21 registered voters of the school district at the next
1 22 regular school election or at a special election. If
1 23 sixty percent of those voting on the question favors
1 24 entering into the agreement, the board shall adopt a
1 25 resolution to enter into the agreement and certify the
1 26 results of the election to the department of
1 27 management."
