  1  1    Amend House File 324 as follows:
  1  2    #1.  Page 1, by inserting before line 3 the
  1  3 following:
  1  4    "Section 1.  Section 73A.2, Code 2001, is amended
  1  5 to read as follows:
  1  6    73A.2  NOTICE OF HEARING.
  1  7    Before any municipality shall enter into any
  1  8 contract for any public improvement to cost twenty-
  1  9 five one hundred thousand dollars or more, the
  1 10 governing body proposing to make the contract shall
  1 11 adopt proposed plans and specifications and proposed
  1 12 form of contract, fix a time and place for hearing at
  1 13 the municipality affected or other nearby convenient
  1 14 place, and give notice by publication in at least one
  1 15 newspaper of general circulation in the municipality
  1 16 at least ten days before the hearing.
  1 17    Sec.    .  Section 73A.18, Code 2001, is amended to
  1 18 read as follows:
  1 19    73A.18  WHEN BIDS REQUIRED – ADVERTISEMENT –
  1 20 DEPOSIT.
  1 21    When the estimated total cost of construction,
  1 22 erection, demolition, alteration or repair of a public
  1 23 improvement exceeds twenty-five one hundred thousand
  1 24 dollars, the municipality shall advertise for bids on
  1 25 the proposed improvement by two publications in a
  1 26 newspaper published in the county in which the work is
  1 27 to be done.  The first advertisement for bids shall be
  1 28 not less than fifteen days prior to the date set for
  1 29 receiving bids.  The municipality shall let the work
  1 30 to the lowest responsible bidder submitting a sealed
  1 31 proposal.  However, if in the judgment of the
  1 32 municipality bids received are not acceptable, all
  1 33 bids may be rejected and new bids requested.  A bid
  1 34 shall be accompanied, in a separate envelope, by a
  1 35 deposit of money or a certified check or credit union
  1 36 certified share draft in an amount to be named in the
  1 37 advertisement for bids as security that the bidder
  1 38 will enter into a contract for the doing of the work.
  1 39 The municipality shall fix the bid security in an
  1 40 amount equal to at least five percent, but not more
  1 41 than ten percent of the estimated total cost of the
  1 42 work.  The checks, share drafts or deposits of money
  1 43 of the unsuccessful bidders shall be returned as soon
  1 44 as the successful bidder is determined, and the check,
  1 45 share draft or deposit of money of the successful
  1 46 bidder shall be returned upon execution of the
  1 47 contract documents.  This section  does not apply to
  1 48 the construction, erection, demolition, alteration or
  1 49 repair of a public improvement when the contracting
  1 50 procedure for the doing of the work is provided for in
  2  1 another provision of law."
  2  2    #2.  Page 4, by inserting after line 16 the
  2  3 following:
  2  4    "Sec.    .  Section 384.96, Code 2001, is amended
  2  5 to read as follows:
  2  6    384.96  SEALED BIDS.
  2  7    When the estimated total cost to a city of a public
  2  8 improvement exceeds the sum of twenty-five one hundred
  2  9 thousand dollars, the governing body shall advertise
  2 10 for sealed bids for the proposed improvement by
  2 11 publishing a notice to bidders as provided in section
  2 12 362.3, except that the notice to bidders may be
  2 13 published more than twenty days but not more than
  2 14 forty-five days before the date for filing bids.
  2 15    Sec.    .  Section 384.102, Code 2001, is amended
  2 16 to read as follows:
  2 17    384.102  WHEN HEARING NECESSARY.
  2 18    When the estimated total cost of a public
  2 19 improvement exceeds the sum of twenty-five one hundred
  2 20 thousand dollars, the governing body shall not enter
  2 21 into a contract for the improvement until it has held
  2 22 a public hearing on the proposed plans,
  2 23 specifications, and form of contract, and estimated
  2 24 cost for the improvement.  Notice of the hearing must
  2 25 be published as provided in section 362.3.  At the
  2 26 hearing any interested person may appear and file
  2 27 objections to the proposed plans, specifications,
  2 28 contract, or estimated cost of the improvement.  After
  2 29 hearing objections, the governing body shall by
  2 30 resolution enter its decision on the plans,
  2 31 specifications, contract, and estimated cost."
  2 32    #3.  Title page, line 1, by inserting after the
  2 33 word "transportation" the following:  "and
  2 34 infrastructure".
  2 35    #4.  By renumbering, redesignating, and correcting
  2 36 internal references as necessary.
