  1  1    Section 1.  Section 422.45, Code Supplement 1999, is
  1  2 amended by adding the following new subsection:
  1  3    NEW SUBSECTION.  57.  The gross receipts from the
  1  4 performing, rendering, furnishing, sale, or rental of
  1  5 information services, including data processing services,
  1  6 regardless of how the resultant information is transferred
  1  7 from seller to buyer if the information is accumulated,
  1  8 prepared, or organized for the buyer.  Information
  1  9 accumulated, prepared, or organized for a buyer is an
  1 10 information service even though it may incorporate preexisting
  1 11 components of data or other information.  Information services
  1 12 exempt under this subsection include, but are not limited to,
  1 13 database files, mailing lists, market research, credit
  1 14 reports, and surveys.
  1 15    Sec. 2.  REFUNDS.  Refunds of taxes, interest, or penalties
  1 16 which arise from claims resulting from the enactment of
  1 17 section 422.45, subsection 57, in this Act, for the
  1 18 furnishing, sale, or rental of information services occurring
  1 19 between March 15, 1995, and the effective date of this Act,
  1 20 shall be limited to twenty-five thousand dollars in the
  1 21 aggregate and shall not be allowed unless refund claims are
  1 22 filed prior to October 1, 2000, notwithstanding any other
  1 23 provision of law.  If the amount of claims totals more than
  1 24 twenty-five thousand dollars in the aggregate, the department
  1 25 of revenue and finance shall prorate the twenty-five thousand
  1 26 dollars among all claimants in relation to the amounts of the
  1 27 claimants' valid claims.
  1 28    Sec. 3.  EFFECTIVE DATE AND RETROACTIVE APPLICABILITY
  1 29 PROVISION.  This Act, being deemed of immediate importance,
  1 30 takes effect upon enactment and applies retroactively to March
  1 31 15, 1995.  
  1 32                           EXPLANATION
  1 33    This bill exempts from the sales and use taxes the
  1 34 furnishing, sale, or rental of information or data services
  1 35 regardless of how the resultant data is transferred.
  2  1 Information which is accumulated, prepared, or organized for a
  2  2 buyer is an information service.  Information services include
  2  3 but are not limited to database files, mailing lists, market
  2  4 research, credit reports, and surveys.
  2  5    The bill takes effect upon enactment and applies
  2  6 retroactively to March 15, 1995.  As a result of the
  2  7 retroactivity of the exemption, refunds are provided for but
  2  8 limited to $25,000 in the aggregate.
