  1  1    Section 1.  Section 28.3, subsection 2, Code Supplement
  1  2 1999, is amended to read as follows:
  1  3    2.  The Iowa board shall consist of fifteen seventeen
  1  4 voting members with twelve thirteen citizen members and three
  1  5 four state agency members.  The three four state agency
  1  6 members shall be the directors of the following departments:
  1  7 education, human rights, human services, and public health.
  1  8 The twelve thirteen citizen members shall be appointed by the
  1  9 governor, subject to confirmation by the senate.  The
  1 10 governor's appointments of citizen members shall be made in a
  1 11 manner so that each of the state's congressional districts is
  1 12 represented by two citizen members and so that all the
  1 13 appointments as a whole reflect the ethnic, cultural, social,
  1 14 and economic diversity of the state.  The governor's
  1 15 appointees shall be selected from individuals nominated by
  1 16 community empowerment area boards.  The nominations shall
  1 17 reflect the range of interests represented on the community
  1 18 boards so that the governor is able to appoint one or more
  1 19 members each for education, health, human services, business,
  1 20 faith, and public interests.  At least one of the citizen
  1 21 members shall be a service consumer or the parent of a service
  1 22 consumer.  Terms of office of all citizen members are three
  1 23 years.  A vacancy on the board shall be filled in the same
  1 24 manner as the original appointment for the balance of the
  1 25 unexpired term.
  1 26    Sec. 2.  Section 28.4, subsection 12, paragraph d,
  1 27 unnumbered paragraph 1, Code Supplement 1999, is amended to
  1 28 read as follows:
  1 29    The Iowa empowerment board shall regularly make information
  1 30 available identifying community empowerment funding and
  1 31 funding distributed through the funding streams listed under
  1 32 this paragraph "d" to communities.  It is the intent of the
  1 33 general assembly that the community empowerment area boards
  1 34 and the administrators of the programs located within the
  1 35 community empowerment areas that are supported by the listed
  2  1 funding streams shall fully cooperate with one another on or
  2  2 before the indicated fiscal years, in order to avoid
  2  3 duplication, enhance efforts, combine planning, and take other
  2  4 steps to best utilize the funding to meet the needs of the
  2  5 families in the areas.  The agencies involved with the
  2  6 programs shall work with the community empowerment areas and
  2  7 the local entities providing the programs to outline the
  2  8 efforts for full cooperation in a written agreement.  The
  2  9 community empowerment area boards and the administrators shall
  2 10 annually submit a report concerning such efforts and a copy of
  2 11 the written agreement to the community empowerment office.  If
  2 12 a community empowerment area is receiving a school ready
  2 13 children grant, this report shall be an addendum to the annual
  2 14 report required under section 28.8.  The state community
  2 15 empowerment facilitator shall compile and summarize the
  2 16 reports which shall be submitted to the governor, general
  2 17 assembly, and Iowa board.  The funding streams shall include
  2 18 all of the following:
  2 19    Sec. 3.  Section 28.8, subsection 4, Code Supplement 1999,
  2 20 is amended to read as follows:
  2 21    4.  The community board shall submit an annual report on
  2 22 the effectiveness of the grant program in addressing school
  2 23 readiness and children's health and safety needs to the Iowa
  2 24 empowerment board and to the local governing bodies.  The
  2 25 annual report shall indicate describe the effectiveness of the
  2 26 community board in achieving state and locally determined
  2 27 goals by reporting the community empowerment area's status
  2 28 with the statewide indicators established by the Iowa board
  2 29 and with the community-specific performance indicators
  2 30 submitted in the grant plan.
  2 31    Sec. 4.  Section 28.8, subsection 5, paragraph a, Code
  2 32 Supplement 1999, is amended to read as follows:
  2 33    a.  A school ready children grant shall be awarded to a
  2 34 community board for a three-year period, with annual payments
  2 35 made to the community board on an annual basis.  The Iowa
  3  1 empowerment board may grant an extension from the award date
  3  2 and any application deadlines based upon the award date, to
  3  3 allow for a later implementation date in the initial year in
  3  4 which a community board submits a comprehensive school ready
  3  5 grant plan to the Iowa empowerment board.  However, receipt of
  3  6 continued funding is subject to submission of the required
  3  7 annual report and the Iowa board's determination that the
  3  8 community board is measuring, through the use of performance
  3  9 indicators developed by the Iowa board with input from
  3 10 community boards, progress toward and is achieving the desired
  3 11 results identified in the grant plan.  If progress is not
  3 12 measured through the use of performance indicators toward
  3 13 achieving the identified results, the Iowa board may request a
  3 14 plan of corrective action or may withdraw grant funding.
  3 15    Sec. 5.  Section 28.8, subsection 5, paragraph b, Code
  3 16 Supplement 1999, is amended to read as follows:
  3 17    b.  The Iowa board shall distribute school ready children
  3 18 grant moneys to community boards with approved comprehensive
  3 19 school ready children grant plans based upon a determination
  3 20 of readiness of the community empowerment area to effectively
  3 21 utilize the moneys, with the grant moneys being adjusted for
  3 22 other federal and state grant moneys to be received by the
  3 23 area for services to children from birth through five years of
  3 24 age.
  3 25    Sec. 6.  Section 28.8, subsection 5, paragraph d, Code
  3 26 Supplement 1999, is amended by striking the paragraph.
  3 27    Sec. 7.  NEW SECTION.  28.8A  SCHOOL READY CHILDREN GRANT
  3 28 FUNDING FORMULA.
  3 29    1.  For the purposes of this section, unless the context
  3 30 otherwise requires, "federal poverty level" means the federal
  3 31 poverty level as defined by the most recently revised poverty
  3 32 income guidelines published by the United States department of
  3 33 health and human services.
  3 34    2.  A distribution formula is established for allocation of
  3 35 school ready children grant funding appropriated for a fiscal
  4  1 year.  The distribution formula factors shall be applied to
  4  2 all counties in the state and the resulting individual county
  4  3 amounts shall be combined to conform with the county area or
  4  4 areas participating in a community empowerment area.
  4  5    3.  A community empowerment area must have an official
  4  6 designation in good standing from the Iowa empowerment board
  4  7 and comply with other requirements applicable to community
  4  8 empowerment areas and school ready children grant funding in
  4  9 order to maintain eligibility for the area's allocation.
  4 10    4.  A county's allocation from the amount available for
  4 11 grant funding distribution in a fiscal year shall be
  4 12 equivalent to the sum of the amounts determined pursuant to
  4 13 following three percentage factors:
  4 14    a.  Forty-five percent based upon the proportion that the
  4 15 county's population of children from birth through age five
  4 16 whose family income is equal to or less than one hundred
  4 17 eighty-five percent of the federal poverty level bears to the
  4 18 state's population of children in that same age group and
  4 19 income level.
  4 20    b.  Thirty-five percent based upon the proportion that the
  4 21 county's population of children from birth through age five
  4 22 bears to the state's general population of children in that
  4 23 age group.
  4 24    c.  An amount determined by equally dividing among all
  4 25 counties twenty percent of the amount available for
  4 26 distribution in that fiscal year.
  4 27    5.  The formula allocation in this section shall be
  4 28 implemented in phases for a community empowerment area
  4 29 receiving a school ready children grant as of June 30, 2000.
  4 30 If the amount available for distribution for a particular
  4 31 fiscal year is insufficient for full funding of all
  4 32 allocations for that phase, the shortfall shall be distributed
  4 33 by reductions in the allocations to all community empowerment
  4 34 areas in the proportion that an individual allocation bears to
  4 35 the total amount of allocations for that phase.  The
  5  1 implementation phases shall be as follows:
  5  2    a.  For the fiscal year beginning July 1, 2001, the
  5  3 community empowerment area's allocation shall be the greater
  5  4 of the formula allocation or seventy-five percent of the
  5  5 annual amount received by the area in the fiscal year
  5  6 beginning July 1, 2000.
  5  7    b.  For the fiscal year beginning July 1, 2002, the
  5  8 community empowerment area's allocation shall be the greater
  5  9 of the formula allocation or fifty percent of the annual
  5 10 amount received by the area in the fiscal year beginning July
  5 11 1, 2000.
  5 12    c.  For the fiscal year beginning July 1, 2003, the
  5 13 community empowerment area's allocation shall be the greater
  5 14 of the formula allocation or twenty-five percent of the annual
  5 15 amount received by the area in the fiscal year beginning July
  5 16 1, 2000.
  5 17    d.  For the fiscal year beginning July 1, 2004, and
  5 18 subsequent fiscal years, the community empowerment area shall
  5 19 be eligible to receive the formula allocation.
  5 20    6.  It is the intent of the general assembly to implement a
  5 21 practice of appropriating for school ready children grant
  5 22 funding during the fiscal year that occurs two years in
  5 23 advance of the fiscal year to which the appropriation applies.
  5 24    Sec. 8.  FUNDING FORMULA – FISCAL YEAR 2000-2001.
  5 25    1.  For the fiscal year beginning July 1, 2000, the
  5 26 department of management shall apply the funding formula
  5 27 described in section 28.8A, as enacted by this Act, to the
  5 28 entire amount available in that fiscal year for distribution
  5 29 for school ready children grants.  However, the formula shall
  5 30 only be used to establish an allocation amount for those
  5 31 community empowerment areas that have never been awarded a
  5 32 school ready children grant as of June 30, 2000.
  5 33    2.  For designated community empowerment areas that have
  5 34 never been awarded a school ready children grant as of June
  5 35 30, 2000, the maximum amount that may be awarded for the
  6  1 fiscal year beginning July 1, 2000, to those areas, shall be
  6  2 50 percent of the amount that would be allocated to the areas
  6  3 under the formula and the grant period shall be January 1,
  6  4 2001, through June 30, 2001.  If the amount available for
  6  5 distribution to all such areas is not sufficient to fully fund
  6  6 the total of the allocations for the areas, the shortfall
  6  7 shall be distributed by reductions in the allocations of those
  6  8 areas in the proportion that an individual allocation bears to
  6  9 the total of the allocations for those areas.
  6 10    Sec. 9.  IOWA EMPOWERMENT BOARD NOMINEES.  Community
  6 11 empowerment boards are encouraged to act expeditiously to
  6 12 submit nominees for the governor's appointment of citizen
  6 13 members to the Iowa empowerment board in order to fulfill the
  6 14 requirements under section 28.3 for the board to include
  6 15 representatives of business, faith, and other interests.
  6 16    Sec. 10.  EFFECTIVE DATE.  Section 9 of this Act, relating
  6 17 to Iowa empowerment board nominees, being deemed of immediate
  6 18 importance, takes effect upon enactment.  
  6 19                           EXPLANATION
  6 20    This bill relates to community empowerment areas by adding
  6 21 members to the Iowa empowerment board, by establishing a
  6 22 formula for distribution of school ready children grant
  6 23 funding, and including other provisions involving the grants.
  6 24    The bill amends Code section 28.3, relating to the
  6 25 membership of the Iowa empowerment board, by adding the
  6 26 director of the department of human rights as a voting member
  6 27 of the board and an additional citizen member.  Under current
  6 28 law, the board consists of 15 voting members with 12 citizen
  6 29 members and three state agency directors.  Under the bill,
  6 30 this total would increase to 17 members.  Current law requires
  6 31 the agencies represented on the board to provide staffing
  6 32 services to the board and for local representatives of the
  6 33 agencies to be part of a technical assistance system developed
  6 34 for community empowerment areas.
  6 35    Code section 28.4, relating to the Iowa empowerment board
  7  1 duties, is amended to require agencies that administer certain
  7  2 locally operated early childhood programs to work with
  7  3 community empowerment areas and the local programs to outline
  7  4 in writing the efforts for full cooperation between the
  7  5 programs.  The written agreement is to be included in the
  7  6 annual report of the empowerment area.
  7  7    The bill includes a number of amendments to Code section
  7  8 28.8, the major statutory provision for the grants.  The
  7  9 annual report is to include specific reporting on the
  7 10 empowerment area's status with statewide indicators and those
  7 11 submitted in the area's grant plan.  The bill changes the
  7 12 grant period from three years to one year.  The bill strikes
  7 13 language for adjusting the grant amount for federal and state
  7 14 moneys to be received by the area for services to children
  7 15 from birth through age five.  The bill strikes language
  7 16 authorizing the Iowa empowerment board to adjust grant amounts
  7 17 based upon population, existence of other funding, local
  7 18 capacity to generate funding, and other factors.
  7 19    New Code section 28.8A establishes a school ready grant
  7 20 program funding formula.  Only community empowerment areas
  7 21 designated by the Iowa empowerment board are eligible to
  7 22 receive an allocation.  The formula uses counties as basic
  7 23 allocation units with these amounts to be combined to
  7 24 establish an allocation amount for a community empowerment
  7 25 area.  The formula establishes allocations using the following
  7 26 factors:  proportion of general population of children from
  7 27 birth through age five, proportion of population of children
  7 28 from birth through age five whose family income is equal to or
  7 29 less than 185 percent of the federal poverty level, and a base
  7 30 amount for each county.  The formula is to be implemented in
  7 31 phases with allocations adjusted to address prior annual grant
  7 32 levels.
  7 33    The bill includes a temporary provision for allocations in
  7 34 fiscal year 2000-2001 to those designated community
  7 35 empowerment areas that have never received a school ready
  8  1 children grant.
  8  2    The bill includes language encouraging the community
  8  3 empowerment board to act expeditiously in submitting nominees
  8  4 for the governor's appointment of citizen members to the Iowa
  8  5 empowerment board representing business, faith, and other
  8  6 interests.  This section takes effect upon enactment.
