  1  1    Section 1.  Section 256.18, subsection 2, Code 1999, is
  1  2 amended to read as follows:
  1  3    2.  The department of education shall establish a character
  1  4 education pilot program to evaluate methods for incorporating
  1  5 positive character qualities into all levels of the existing
  1  6 educational program.  Schools involved in the pilot program
  1  7 may use phase III funds in the establishment of the program.
  1  8    Sec. 2.  Section 256.39, subsection 8, Code 1999, is
  1  9 amended by striking the subsection.
  1 10    Sec. 3.  Section 256A.4, subsection 1, unnumbered paragraph
  1 11 1, Code 1999, is amended to read as follows:
  1 12    The board of directors of each school district may develop
  1 13 and offer a program which provides outreach and incentives for
  1 14 the voluntary participation of expectant parents and parents
  1 15 of children in the period of life from birth through age five,
  1 16 who reside within district boundaries, in educational family
  1 17 support experiences designed to assist parents in learning
  1 18 about the physical, mental, and emotional development of their
  1 19 children.  A district providing a family support program,
  1 20 which seeks additional funding under sections 294A.13 through
  1 21 294A.16, shall meet the requirements of this section and the
  1 22 program shall be subject to approval by the department of
  1 23 education.  A board may contract with another school district
  1 24 or public or private nonprofit agency for provision of the
  1 25 approved program or program site.
  1 26    Sec. 4.  Section 256C.3, subsection 8, unnumbered paragraph
  1 27 2, Code Supplement 1999, is amended to read as follows:
  1 28    A family resource center shall coordinate services provided
  1 29 with existing federal, state, and local programs both to avoid
  1 30 duplication and to provide continuity of services.  A family
  1 31 resource center shall, if possible, be located in a school
  1 32 building or in an existing community facility.  Regardless of
  1 33 where the center is located, the school district shall be the
  1 34 primary decision-making body in any partnership established to
  1 35 create a family resource center.  The establishment of a
  2  1 family resource center is a comprehensive school
  2  2 transformation program under chapter 294A.
  2  3    Sec. 5.  Section 258.17, subsection 4, Code 1999, is
  2  4 amended to read as follows:
  2  5    4.  Each workstart program shall include a written
  2  6 agreement by the school or school district with one or more
  2  7 businesses from the surrounding community to provide
  2  8 workplace-specific training and learning programs which are
  2  9 related to the skills needed to succeed in those occupational
  2 10 areas.  The proposed plan for implementation of the workstart
  2 11 program shall include a copy of the written agreement between
  2 12 the school or school district and the business or businesses
  2 13 and a business support component, which shall consist of
  2 14 financial or in-kind support, or both financial and in-kind
  2 15 support, from the businesses that have entered into the
  2 16 agreement with the school or school district.  The plan may
  2 17 provide for the utilization of phase III and other available
  2 18 school funds in the establishment of the program.  A workstart
  2 19 program is a comprehensive school transformation program under
  2 20 section 294A.14.
  2 21    Sec. 6.  Section 294A.1, subsection 3, Code 1999, is
  2 22 amended to read as follows:
  2 23    3.  Phase III – The enhancement of the quality and
  2 24 effectiveness of teachers through the utilization use of
  2 25 performance pay staff development programs and measures.
  2 26    Sec. 7.  Section 294A.12, Code 1999, is amended by striking
  2 27 the section and inserting in lieu thereof the following:
  2 28    294A.12  GOAL.
  2 29    The goal of phase III is to enhance the quality,
  2 30 effectiveness, and performance of Iowa's teachers by promoting
  2 31 teacher excellence.  This will be achieved by adding to the
  2 32 school calendar two staff development days for the
  2 33 accomplishment of instructional work assignments and staff
  2 34 development.  However, a school district may utilize the
  2 35 additional time in incremental units at its discretion.
  3  1    Sec. 8.  Section 294A.13, Code 1999, is amended by striking
  3  2 the section and inserting in lieu thereof the following:
  3  3    294A.13  PHASE III EXPENDITURES – INTENT.
  3  4    1.  It is the intent of the general assembly that school
  3  5 districts utilize the additional time funded by phase III to
  3  6 support additional work assignments and staff development
  3  7 efforts that incorporate research-based strategies,
  3  8 instruction, and programs in pedagogy, diagnosis, and
  3  9 appropriate interventions, including but not limited to
  3 10 mentoring programs for new teachers, development of teachers
  3 11 as instructional leaders in their schools and school
  3 12 districts, and using teachers to evaluate and suggest
  3 13 modifications of other teachers' techniques.
  3 14    2.  Additional instructional work assignments may include,
  3 15 but are not limited to, general curriculum planning and
  3 16 development, vertical articulation of curriculum, horizontal
  3 17 curriculum coordination, development of educational
  3 18 measurement practices for the school district, participation
  3 19 in assessment activities leading to certification by the
  3 20 national board for professional teaching standards, attendance
  3 21 at workshops and other programs for service as cooperating
  3 22 teachers for student teachers, development of plans for
  3 23 assisting beginning teachers during their first year of
  3 24 teaching, attendance at summer staff development programs,
  3 25 development of staff development programs for other teachers
  3 26 to be presented during the school year, participation in
  3 27 family support programs, development of programs which provide
  3 28 instruction in conflict resolution and mediation techniques
  3 29 for staff and students, instruction in presenting bullying
  3 30 prevention programs and anger management programs for
  3 31 students, and other plans locally determined that are of equal
  3 32 importance or more appropriately meet the educational needs of
  3 33 the school district.
  3 34    Sec. 9.  Section 294A.14, Code 1999, is amended by striking
  3 35 the section and inserting in lieu thereof the following:
  4  1    294A.14  PHASE III PAYMENTS.
  4  2    1.  For each fiscal year, the department shall allocate the
  4  3 remainder of the moneys appropriated by the general assembly
  4  4 to the educational excellence fund for phase III, subject to
  4  5 section 294A.3.  The department shall determine the sum of
  4  6 state foundation aid a school district will receive for the
  4  7 budget year under section 257.16, shall divide that figure by
  4  8 one hundred eighty and shall pay an amount equivalent to that
  4  9 quotient multiplied by two to the school district by September
  4 10 15 from moneys in the fund for phase III.  If, for any fiscal
  4 11 year the amount available in the fund for phase III is
  4 12 insufficient to pay in full the amounts due to all school
  4 13 districts, then the amount of each payment shall be reduced by
  4 14 the same percentage, so that the aggregate payments to all
  4 15 school districts are equal to the amount available for payment
  4 16 in accordance with this section.  If, for any fiscal year the
  4 17 amount appropriated is in excess of the amounts due to school
  4 18 districts, then the amount of each payment shall be increased
  4 19 by the same percentage, so that the aggregate payments to all
  4 20 school districts are equal to the amount available for payment
  4 21 in accordance with this section.
  4 22    2.  If a school district has discontinued grades under
  4 23 section 282.7, subsection 1, or students attend school in
  4 24 another school district, under an agreement with the board of
  4 25 the other school district, the board of directors of the
  4 26 district of residence either shall transmit the phase III
  4 27 moneys allocated to the district for those students based upon
  4 28 the full-time equivalent attendance of those students to the
  4 29 board of the school district of attendance of the students or
  4 30 shall transmit to the board of the school district of
  4 31 attendance of the students a portion of the phase III moneys
  4 32 allocated to the district of residence based upon an agreement
  4 33 between the board of the resident district and the board of
  4 34 the district of attendance.
  4 35    3.  Moneys received under phase III shall not be used to
  5  1 employ additional employees of a school district, except when
  5  2 a substitute teacher is needed while the regular teacher
  5  3 attends a staff development program.  However, all teachers
  5  4 employed are eligible to receive additional salary.
  5  5    4.  Payments shall be separate from state aid payments made
  5  6 pursuant to section 257.16.  Phase III payments made under
  5  7 this section to a school district may be combined and a
  5  8 separate accounting of the amount paid for each program shall
  5  9 be included.
  5 10    5.  Phase III moneys received by a school district, and any
  5 11 interest accrued on the moneys, shall not be commingled with
  5 12 state aid payments made under section 257.16 to a school
  5 13 district and shall be accounted for by the school district
  5 14 separately from state aid payment accounts.
  5 15    6.  Any payments made to school districts or area education
  5 16 agencies under this chapter are miscellaneous income for
  5 17 purposes of chapter 257.
  5 18    7.  Payments made to a teacher by a school district under
  5 19 this chapter are wages for the purposes of chapter 91A except
  5 20 for payments made under a modified payment plan mutually
  5 21 agreed upon by the board of directors and the certified
  5 22 bargaining representative for certificated employees or, for a
  5 23 district that is not organized for collective bargaining
  5 24 purposes, where a modified payment plan is adopted by the
  5 25 board.
  5 26    Sec. 10.  Section 294A.16, Code 1999, is amended by
  5 27 striking the section and inserting in lieu thereof the
  5 28 following:
  5 29    294A.16  AREA EDUCATION AGENCY TEACHERS.
  5 30    If a school district uses teachers under a contract between
  5 31 the district and the area education agency in which the
  5 32 district is located, the school district shall transmit to the
  5 33 employing area education agency a portion of its phase III
  5 34 moneys based upon the portion that the salaries of teachers
  5 35 employed by the area education agency and assigned to the
  6  1 school district for the school year bears to the total teacher
  6  2 salaries paid in the district for that school year, including
  6  3 the salaries of the teachers employed by the area education
  6  4 agency.
  6  5    Sec. 11.  Section 294A.19, Code 1999, is amended by
  6  6 striking the section and inserting in lieu thereof the
  6  7 following:
  6  8    294A.19  REPORTS.
  6  9    1.  Each school district shall include, as a component of
  6 10 the annual report submitted to the department of education in
  6 11 accordance with section 256.7, subsection 21, its staff
  6 12 development goals and a brief description of the district's
  6 13 phase III efforts conducted during the most recent fiscal year
  6 14 toward achievement of the district's goals.  The goals shall
  6 15 be developed by licensed professional staff of the district,
  6 16 including both teachers and administrators.
  6 17    Sec. 12.  Section 294A.25, subsection 1, Code Supplement
  6 18 1999, is amended to read as follows:
  6 19    1.  For the fiscal year beginning July 1, 1998, and for
  6 20 each succeeding year, there is appropriated from the general
  6 21 fund of the state to the department of education the amount of
  6 22 eighty-two million eight hundred ninety-one thousand three
  6 23 hundred thirty-six dollars to be used to improve teacher
  6 24 salaries and promote teacher excellence.  The moneys shall be
  6 25 distributed as provided in this section.
  6 26    Sec. 13.  Section 294A.25, subsection 5, Code Supplement
  6 27 1999, is amended by striking the subsection.
  6 28    Sec. 14.  Section 331.909, subsection 2, Code 1999, is
  6 29 amended to read as follows:
  6 30    2.  The activities of a multidisciplinary community
  6 31 services team shall not duplicate the activities of a
  6 32 multidisciplinary team for child abuse under section 235A.13,
  6 33 dependent adult abuse activities under section 235B.6, area
  6 34 education agency activities under section 294A.14, or child
  6 35 victim services provided under section 915.35.
  7  1    Sec. 15.  Sections 294A.15, 294A.17, 294A.18, 294A.20,
  7  2 294A.22, and 294A.23, Code 1999, are repealed.  
  7  3                           EXPLANATION
  7  4    This bill substantially changes phase III of the
  7  5 educational excellence program.  Currently, each school
  7  6 district and area education agency that meets phase III
  7  7 requirements is eligible to receive phase III moneys for the
  7  8 implementation of a performance-based pay plan or supplemental
  7  9 pay plan, or a combination of the two.  Under the bill, phase
  7 10 III moneys are to be paid to school districts to fund the
  7 11 equivalent of two additional staff development days.  The bill
  7 12 makes the following Code changes:
  7 13    Code section 256.18(2); 256.39(8); 256A.4(1), unnumbered
  7 14 paragraph 1; 256C.3(8), unnumbered paragraph 2; 258.17(4);
  7 15 331.909(2):  Strikes provisions that permit certain programs
  7 16 to qualify for or otherwise use phase III funds, as well as a
  7 17 provision that prevents any duplication of services by an area
  7 18 education agency participating in phase III activities.
  7 19    Code section 294A.1(3):  Describes phase III as the phase
  7 20 of the educational excellence program that addresses the
  7 21 enhancement of the quality and effectiveness of teachers
  7 22 through the use of staff development programs and measures.
  7 23    Code section 294A.12:  Describes the new goal for phase
  7 24 III, which is to enhance the quality, effectiveness, and
  7 25 performance of Iowa's teachers by promoting teacher excellence
  7 26 by adding two staff development days to the school calendar
  7 27 for the accomplishment of instructional work assignments and
  7 28 staff development.
  7 29    Code section 294A.13:  Includes the intent of the general
  7 30 assembly regarding school district use of the additional time
  7 31 funded by phase III.  Describes the additional instructional
  7 32 work assignments and staff development efforts that a school
  7 33 district may fund with phase III moneys.
  7 34    Code section 294A.14:  Describes the method the department
  7 35 of education shall use to determine the amount of phase III
  8  1 funding each school district shall receive.  Includes
  8  2 provisions for reducing or increasing the amount paid to a
  8  3 school district dependent upon whether the amounts due to
  8  4 school districts are more than the phase III moneys available
  8  5 or the amount remaining in the educational excellence fund
  8  6 exceeds the amounts due to school districts.  Directs, if a
  8  7 school district is participating in a sharing agreement, the
  8  8 school district of residence to transmit phase III moneys to
  8  9 the receiving school district.  Provides that moneys received
  8 10 under phase III must not be used to employ additional
  8 11 employees, except when a substitute teacher is needed while
  8 12 the regular teacher attends a staff development program.
  8 13    Code section 294A.16:  Requires a school district that uses
  8 14 teachers under a contract between the district and the area
  8 15 education agency to transmit to the employing area education
  8 16 agency a portion of its phase III moneys.
  8 17    Code section 294A.19:  Requires each school district to
  8 18 include in its comprehensive school improvement plan, which is
  8 19 submitted to the department of education annually, its
  8 20 practitioner-developed staff development goals and a brief
  8 21 description of the district's phase III efforts.
  8 22    Code section 294A.25(1):  Provides that the moneys
  8 23 appropriated for the educational excellence program are to be
  8 24 used to improve teacher salaries and promote teacher
  8 25 excellence.
  8 26    The bill also strikes an outdated provision, Code section
  8 27 294A.25, subsection 5, and repeals Code sections 294A.15,
  8 28 294A.17, 294A.18, 294A.20, 294A.22, and 294A.23, which
  8 29 describe phase III planning, determination of allocation,
  8 30 payment, and use and implementation provisions that are
  8 31 unnecessary or in conflict with the new distribution and use
  8 32 for phase III moneys.
