  1  1    Section 1.  Section 232.2, subsection 12, Code Supplement
  1  2 1999, is amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  d.  The violation of section 724.22,
  1  4 subsection 2, that is committed by a child.
  1  5    Sec. 2.  Section 724.22, subsection 2, Code 1999, is
  1  6 amended to read as follows:
  1  7    2.  Except as provided in subsections 4 and 5, a:
  1  8    a.  A person who sells, loans, gives, or makes available a
  1  9 pistol or revolver or ammunition for a pistol or revolver to a
  1 10 person below the age of twenty-one commits a serious
  1 11 misdemeanor for a first offense and a class "D" felony for
  1 12 second and subsequent offenses.
  1 13    b.  (1)  A person under eighteen years of age who possesses
  1 14 a pistol or revolver or ammunition for a pistol or revolver
  1 15 commits a delinquent act.
  1 16    (2)  A person eighteen years of age or older, but under the
  1 17 age of twenty-one, who possesses a pistol or revolver or
  1 18 ammunition for a pistol or revolver commits a serious
  1 19 misdemeanor.
  1 20    Sec. 3.  NEW SECTION.  724.22A  TRIGGER OR GUN LOCKS
  1 21 REQUIRED AT POINT-OF-SALE – INSTRUCTIONS, INFORMATION, AND
  1 22 POSTING.
  1 23    1.  A person that engages in the retail sale of pistols or
  1 24 revolvers, other than an antique firearm, shall provide to a
  1 25 purchaser at the time of the sale of the pistol or revolver a
  1 26 trigger lock, gun lock, or gun-locking device appropriate for
  1 27 such pistol or revolver and that renders the pistol or
  1 28 revolver inoperable while installed.  The seller shall offer
  1 29 to demonstrate its use.
  1 30    2.  A person that engages in the retail sale of pistols or
  1 31 revolvers, other than an antique firearm, shall post
  1 32 information that shall be provided by the department of public
  1 33 safety promoting the safe storage of weapons and providing
  1 34 information on the availability of weapons training programs.
  1 35    3.  This section does not apply to the sale of a pistol or
  2  1 revolver by an individual who is not regularly engaged, either
  2  2 full-time or part-time, in a business of selling, buying for
  2  3 resale, or exchanging firearms as a principal or agent.  
  2  4                           EXPLANATION
  2  5    This bill requires a firearm dealer to provide a gun-
  2  6 locking device and certain related information at the time of
  2  7 sale of a pistol or revolver.
  2  8    New Code section 724.22A requires a retail seller to
  2  9 provide a trigger lock, gun lock, or other gun-locking device
  2 10 to any purchaser of a pistol or revolver other than an antique
  2 11 firearm, and offer to demonstrate its use.  The seller must
  2 12 post on the business premises information regarding gun safety
  2 13 courses and the safe storage of weapons as provided by the
  2 14 department of public safety.  New Code section 724.22A does
  2 15 not apply to sales of pistols or revolvers by individuals who
  2 16 are not regularly engaged in the business of selling, buying
  2 17 for resale, or exchanging firearms.
  2 18    The bill also adds a new provision to Code section 724.22,
  2 19 making possession by a minor of a pistol or revolver or
  2 20 ammunition for a pistol or revolver a delinquent act, and
  2 21 possession of a pistol, revolver, or ammunition for a pistol
  2 22 or revolver by a person 18 years or older, but under 21, a
  2 23 serious misdemeanor.  A corresponding amendment is also made
  2 24 to Code chapter 232, relating to delinquent acts by juveniles.
