1 1 Section 1. Section 257.20, subsection 2, Code 1999, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. c. If the amount of instructional support
1 4 state aid which a school district receives pursuant to
1 5 paragraph "a" or "b" is less than the amount which the
1 6 district would otherwise have received if the appropriation
1 7 had been an amount necessary to pay instructional support
1 8 state aid as determined under subsection 1, the school
1 9 district shall be eligible to increase the portion of its
1 10 instructional support budget that is local funding. The local
1 11 funding increase may be in an amount up to the level of
1 12 instructional support state aid which the school district
1 13 would have received if the appropriation had been an amount
1 14 necessary to pay instructional support state aid as determined
1 15 under subsection 1. To increase the amount of local funding
1 16 pursuant to this paragraph, a school district participating in
1 17 the instructional support program on the effective date of
1 18 this Act shall, pursuant to section 257.18, either adopt a
1 19 resolution to increase the amount of the local funding if the
1 20 remaining amount of the term does not exceed five years, or
1 21 submit the question for election if the remaining amount of
1 22 the term exceeds five years but does not exceed ten years. If
1 23 the question of increasing the amount of the local funding is
1 24 submitted for election, the question at election shall be
1 25 increasing the level of local funding from the existing level
1 26 up to the additional amount of local funding to be received
1 27 pursuant to this paragraph.
1 28 EXPLANATION
1 29 This bill provides for additional local funding authority
1 30 under the instructional support levy.
1 31 The bill provides that if the amount of instructional
1 32 support state aid which a school district receives, pursuant
1 33 to Code section 257.20, subsection 2, which restricts the
1 34 level of instructional support state aid to the amount
1 35 received for the budget year beginning July 1, 1992, is less
2 1 than the amount the school district would otherwise have
2 2 received if the restriction did not apply, the school district
2 3 may increase the portion of its instructional support budget
2 4 that is local funding. The local funding increase may be in
2 5 an amount up to the level of instructional support state aid
2 6 which the school district would have received if the
2 7 restriction did not apply.
2 8 The bill provides that to increase the amount of local
2 9 funding, a school district participating in the instructional
2 10 support program on the effective date of the bill must either
2 11 adopt a resolution to increase the amount of the local funding
2 12 if the remaining amount of the term does not exceed five
2 13 years, or submit the question for election if the remaining
2 14 amount of the term exceeds five years but does not exceed 10
2 15 years, pursuant to Code section 257.18. The bill further
2 16 provides that if the question of increasing the amount of the
2 17 local funding is submitted for election, the question at
2 18 election shall be increasing the level of local funding from
2 19 the existing level up to the additional amount of local
2 20 funding to be received.
