1 1 Section 1. Section 364.2, subsection 4, paragraph d, Code
1 2 1999, is amended to read as follows:
1 3 d. The person asking for the granting, amending,
1 4 extension, or renewal of a franchise shall pay the costs
1 5 incurred in holding the election and public hearings,
1 6 including the costs of the notice of the election or the costs
1 7 of public hearings, as applicable. A franchise shall not be
1 8 finally effective until an acceptance in writing has been
1 9 filed with the council and payment of the costs has been made.
1 10 Sec. 2. Section 364.2, subsection 4, Code 1999, is amended
1 11 by adding the following new paragraph:
1 12 NEW PARAGRAPH. g. Notwithstanding paragraph "b", which
1 13 otherwise requires approval of a franchise at an election, an
1 14 ordinance granting a franchise shall become effective without
1 15 an election if the ordinance is read at two public hearings
1 16 and a valid petition requesting an election as defined in
1 17 section 362.4 has not been filed before the franchise may
1 18 become finally effective pursuant to paragraph "d".
1 19 EXPLANATION
1 20 This bill provides that an election to approve a franchise
1 21 ordinance is not required if the franchise ordinance is read
1 22 at two public hearings held by the city council and a valid
1 23 petition requesting an election is not filed before the
1 24 franchise becomes finally effective. The person asking for
1 25 the franchise must file a written acceptance of the franchise
1 26 with the city council and pay the costs of public hearing
1 27 notices and the public hearings.
