1 1 Section 1. Section 902.12, Code 1999, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 6. Burglary in the first degree in
1 4 violation of section 713.3, subsection 1, paragraph "c" or
1 5 "d".
1 6 EXPLANATION
1 7 This bill relates to the maximum accumulation of good
1 8 conduct time for certain burglary in the first degree
1 9 offenses.
1 10 The bill provides that an offender who is sentenced for the
1 11 offense of burglary in the first degree shall serve a sentence
1 12 that is subject to the maximum accumulation of good conduct
1 13 time of 15 percent of the total sentence, commonly known as an
1 14 85 percent sentence. The bill applies to burglary in the
1 15 first degree offenses that involve a person intentionally or
1 16 recklessly inflicting a bodily injury or committing sexual
1 17 abuse while perpetrating such a burglary.
1 18 Burglary in the first degree is a class "B" felony. A
1 19 class "B" felony is punishable by confinement for no more than
1 20 25 years.
