PAG LIN 1 1 Section 1. NEW SECTION. 477D.1 SHORT TITLE. 1 2 This chapter shall be known and may be cited as the 1 3 "Internet Access Enhancement Act of 1999". 1 4 Sec. 2. NEW SECTION. 477D.2 DEFINITIONS. 1 5 As used in this chapter, unless the context otherwise 1 6 requires: 1 7 1. "Affiliate" means a person who, directly or indirectly, 1 8 owns or controls, is owned or controlled by, or is under 1 9 common ownership or control with, another person. For 1 10 purposes of this subsection, "owns" means to own an equity or 1 11 other financial interest, or an equivalent interest, of more 1 12 than ten percent, or any management interest. 1 13 2. "Broadband" means a capability in excess of one hundred 1 14 forty-four kilobits per second. 1 15 3. "Broadband internet access transport services" means 1 16 the broadband transmission of data between a user and the 1 17 user's internet service provider's point of interconnection 1 18 with the wireline broadband internet access transport 1 19 provider's facilities. 1 20 4. "Internet" means the federated network of networks, 1 21 including the national research and education network or a 1 22 successor to that network, whose standards are regulated by 1 23 the internet architecture board. 1 24 5. "Internet service provider" means a person who provides 1 25 a service that enables a user to access the internet including 1 26 any content, information, electronic mail, or other service 1 27 offered over the internet. 1 28 6. "Wireline broadband internet access transport provider" 1 29 means a person who provides broadband internet access 1 30 transport services for a fee, by means of wire, cable, or 1 31 other like connections, over facilities owned or leased by the 1 32 provider or otherwise under the provider's control, directly 1 33 or indirectly to the public. 1 34 Sec. 3. NEW SECTION. 477D.3 DUTY OF WIRELINE BROADBAND 1 35 INTERNET ACCESS TRANSPORT PROVIDER TO PROVIDE ACCESS TO 2 1 INTERNET SERVICE PROVIDERS. 2 2 A wireline broadband internet access transport provider who 2 3 is, or is an affiliate of, an internet service provider shall 2 4 provide any other requesting internet service provider access 2 5 to its broadband internet access transport services, unbundled 2 6 from the provision of content, upon such rates, terms, and 2 7 conditions that are at least as favorable as those rates, 2 8 terms, and conditions which the wireline broadband internet 2 9 access transport provider uses to provide such access to 2 10 itself, to its affiliates, or to any other person. Such 2 11 access shall be provided at any technically feasible point 2 12 selected by the requesting internet service provider. 2 13 EXPLANATION 2 14 This bill creates new Code chapter 477D relating to 2 15 internet access. The bill provides that a wireline broadband 2 16 internet access transport provider who is, or is an affiliate 2 17 of, an internet service provider shall provide any other 2 18 requesting internet service provider access to its broadband 2 19 internet access transport services, unbundled from the 2 20 provision of content, upon rates, terms, and conditions that 2 21 are at least as favorable as those which the wireline 2 22 broadband internet access transport provider uses to provide 2 23 such access to itself, to its affiliates, or to any other 2 24 person. 2 25 LSB 3400SC 78 2 26 mj/cf/24
