  1  1    Section 1.  NEW SECTION.  256.57  ENRICH IOWA PROGRAM –
  1  2 INTENT.
  1  3    1.  The general assembly finds and declares that the public
  1  4 library is at the heart of each community, an integral
  1  5 component in this state's education system, and an invaluable
  1  6 source of wisdom and knowledge for this state's lifelong
  1  7 learners.  It is therefore in the interest of the citizens of
  1  8 Iowa that a comprehensive initiative be undertaken to reduce
  1  9 inequities in the provision of library services throughout the
  1 10 state and to provide public libraries with the funds necessary
  1 11 to meet the present and future needs of this state's citizens.
  1 12    2.  If the general assembly appropriates moneys for the
  1 13 enrich Iowa program, the enrich Iowa program is created within
  1 14 the department to be administered by the division.  Funds
  1 15 appropriated for purposes of the enrich Iowa program shall be
  1 16 distributed by the division to eligible public libraries that
  1 17 are in compliance with performance measures adopted by rule by
  1 18 the commission.  The amount distributed to each eligible
  1 19 public library shall be based upon the following:
  1 20    a.  The level of compliance by the eligible public library
  1 21 with the performance measures adopted by the commission as
  1 22 provided in this subsection.
  1 23    b.  The number of people residing within an eligible
  1 24 library's geographic service area for whom the library
  1 25 provides services.
  1 26    c.  The amount of other funding the eligible public library
  1 27 received in the previous fiscal year for providing services to
  1 28 rural residents and to contracting communities.
  1 29    3.  Moneys received by a public library under this section
  1 30 shall supplement, not supplant, any other funding received by
  1 31 the library.
  1 32    4.  For purposes of this section, "eligible public library"
  1 33 means a public library that meets at least all of the
  1 34 following requirements:
  1 35    a.  Submits to the division all of the following:
  2  1    (1)  The report provided for under section 256.51,
  2  2 subsection 1, paragraph "h".
  2  3    (2)  An application and accreditation report, in a format
  2  4 approved by the commission, that provides evidence of the
  2  5 library's compliance with at least one level of the standards
  2  6 established in accordance with section 256.51, subsection 1,
  2  7 paragraph "k".
  2  8    (3)  Any other application or report the division deems
  2  9 necessary for the implementation of the enrich Iowa program.
  2 10    b.  Participates in the library resource and information
  2 11 sharing programs established by the state library.
  2 12    c.  Is a public library established by city ordinance or a
  2 13 county library as provided in chapter 336.
  2 14    5.  Each eligible public library shall maintain a separate
  2 15 listing within their budgets for payments received and
  2 16 expenditures made pursuant to this section, and shall annually
  2 17 submit this listing to the division.
  2 18    6.  By January 15 of each year, the division shall submit a
  2 19 program evaluation report to the general assembly and the
  2 20 governor detailing the uses and the impacts of funds
  2 21 appropriated under this section.
  2 22    7.  Notwithstanding section 8.33, unencumbered or
  2 23 unobligated funds remaining on June 30 of the fiscal year for
  2 24 which the funds were appropriated shall not revert but shall
  2 25 be available for expenditure for the following fiscal year for
  2 26 purposes of this section.
  2 27    Sec. 2.  EMERGENCY RULES.  The commission of libraries
  2 28 shall adopt emergency rules under section 17A.4, subsection 2,
  2 29 and section 17A.5, subsection 2, paragraph "b", adopting the
  2 30 performance measures referred to in 286 IAC 3.6, and the rules
  2 31 shall be effective immediately upon filing unless a later date
  2 32 is specified in the rules.  Any rules adopted in accordance
  2 33 with this section shall also be published as a notice of
  2 34 intended action as provided in section 17A.4.
  2 35    Sec. 3.  EFFECTIVE DATE.  Section 2 of this Act, relating
  3  1 to emergency rules, being deemed of immediate importance,
  3  2 takes effect upon enactment.  
  3  3                           EXPLANATION
  3  4    This bill establishes the enrich Iowa program within the
  3  5 department of education and administered by the division of
  3  6 libraries and information services.
  3  7    The program provides direct distribution of moneys
  3  8 appropriated to eligible city and county public libraries in
  3  9 compliance with performance measures adopted by the commission
  3 10 of libraries.  The amount distributed to a library under the
  3 11 bill shall be based upon compliance, the number of people
  3 12 residing within the library's geographic service area, and the
  3 13 amount of funding the library received in the previous fiscal
  3 14 year for service to rural residents and to contracting
  3 15 communities.
  3 16    Each eligible public library shall maintain a separate
  3 17 listing within its budget for payments received and
  3 18 expenditures under the program, and must annually submit the
  3 19 listing to the division.
  3 20    The bill directs the division to submit, by January 15 of
  3 21 each year, a program evaluation report to the general assembly
  3 22 and the governor detailing the use and the impact of funds
  3 23 appropriated.
  3 24    The bill directs the commission of libraries to adopt
  3 25 emergency rules setting forth the performance measures
  3 26 referred to in 286 IAC 3.6, and the rules shall be effective
  3 27 immediately upon filing unless a later date is specified in
  3 28 the rules.  This provision takes effect upon enactment.
