Senate Study Bill 1181

  1  1    Section 1.  Section 422.45, Code 1999, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  55.  The gross receipts from the sale of
  1  4 textbooks by a bookstore to a full-time or part-time student
  1  5 enrolled at an accredited higher education institution.  This
  1  6 exemption applies only if the person presents evidence that
  1  7 identifies the person as a student at an accredited higher
  1  8 education institution and presents evidence of enrollment at
  1  9 the institution.  For purposes of this subsection:
  1 10    a.  "Accredited higher education institution" means the
  1 11 same as defined in section 261.92.
  1 12    b.  "Bookstore" means a store that sells textbooks and is
  1 13 located within the city limits of the accredited higher
  1 14 education institution.
  1 15    c.  "Full-time student" means an individual who is enrolled
  1 16 in a course of study for at least twelve semester hours or the
  1 17 trimester or the quarter equivalent of twelve semester hours.
  1 18    d.  "Part-time student" means an individual who is enrolled
  1 19 in a course of study for at least three semester hours or the
  1 20 trimester or the quarter equivalent of three semester hours.
  1 21    e.  "Textbook" means the same as defined in section 301.1
  1 22 but for students at accredited higher education institutions.  
  1 23                           EXPLANATION
  1 24    The bill exempts from the sales and use taxes the sale of
  1 25 textbooks by a bookstore located in the city of an accredited
  1 26 higher education institution to a full-time or part-time
  1 27 student enrolled in such institution.  The student must
  1 28 provide proof of identification as a student and proof of
  1 29 enrollment.  Accredited higher education institutions include
  1 30 the board of regents institutions, community colleges, and
  1 31 private colleges and universities located in the state.
  1 32 Textbooks include electronic textbooks, computer software,
  1 33 interactive videodiscs, and other computer courseware and
  1 34 magnetic media.
