1 1 Section 1. Section 331.756, Code 1999, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 69. Institute legal proceedings to
1 4 enforce solid waste laws as provided in sections 455B.307 and
1 5 455B.307A.
1 6 Sec. 2. Section 455B.307, Code 1999, is amended by adding
1 7 the following new subsection:
1 8 NEW SUBSECTION. 4. A county attorney may seek judicial
1 9 enforcement of the requirements in this section regarding the
1 10 dumping or depositing of solid waste at any place other than a
1 11 sanitary disposal project approved by the director by
1 12 instituting legal proceeding seeking imposition of a civil
1 13 penalty provided a civil penalty is not already being sought
1 14 for the same violation.
1 15 Sec. 3. Section 455B.307A, Code 1999, is amended by adding
1 16 the following new subsection:
1 17 NEW SUBSECTION. 4. A county attorney may seek judicial
1 18 enforcement of the requirements in this section by instituting
1 19 legal proceedings seeking imposition of a civil penalty
1 20 provided a civil penalty is not already being sought for the
1 21 same violation.
1 22 EXPLANATION
1 23 This bill allows a county attorney to seek judicial
1 24 enforcement through imposition of civil penalties for
1 25 violations relating to the dumping or depositing of solid
1 26 waste at any place other than a sanitary disposal project
1 27 approved by the director and the illegal discarding of solid
1 28 waste provided a civil penalty is not already being sought for
1 29 the same violation.
