  1  1    Section 1.  Section 598.35, unnumbered paragraph 2, Code
  1  2 1999, is amended to read as follows:
  1  3    A petition for grandchild or great-grandchild visitation
  1  4 rights shall be granted only upon a finding that the
  1  5 visitation is in the best interests interest of the child and
  1  6 that the grandparent or great-grandparent had established a
  1  7 substantial relationship with the child prior to the filing of
  1  8 the petition.  
  1  9                           EXPLANATION
  1 10    This bill eliminates a condition for the granting of a
  1 11 petition by the court for visitation rights, which is filed by
  1 12 a grandparent or great-grandparent.  The condition eliminated
  1 13 is that the grandparent or great-grandparent had established a
  1 14 substantial relationship with the child prior to the filing of
  1 15 the petition.  The condition that the granting of the petition
  1 16 shall be in the best interest of the child is retained.
