  1  1    Section 1.  MORATORIUM ON ANNEXATION BY A CITY.
  1  2 Notwithstanding chapter 368, division III, from the effective
  1  3 date of this Act until final adjournment of the second regular
  1  4 session of the Seventy-eighth General Assembly meeting in the
  1  5 year 2000, the city development board shall not accept a
  1  6 petition for annexation of territory to a city and shall not
  1  7 accept for filing a moratorium agreement pursuant to section
  1  8 368.4.  During the period of the moratorium, the board shall
  1  9 also discontinue any actions or proceedings relating to a
  1 10 hearing, approval, or election on a petition or plan for
  1 11 annexation of territory filed on or after January 1, 1999.
  1 12 After the moratorium expires, the board may proceed with the
  1 13 implementation of petitions and plans relating to annexations
  1 14 of territory pursuant to chapter 368, division III.
  1 15    Sec. 2.  MORATORIUM ON CERTAIN DEVELOPMENT ACTIONS BY
  1 16 COUNTIES.  Notwithstanding chapter 354, from the effective
  1 17 date of this Act until final adjournment of the second regular
  1 18 session of the Seventy-eighth General Assembly meeting in the
  1 19 year 2000, a county shall not issue any permits,
  1 20 authorizations, or approvals necessary for the subdivision and
  1 21 partitioning of, or construction on, any land located in the
  1 22 unincorporated areas of the county except for reconstruction
  1 23 or rehabilitation of existing buildings or structures and new
  1 24 construction, reconstruction, or rehabilitation of
  1 25 agricultural buildings.  After the moratorium expires, a
  1 26 county may proceed with issuance of any permits,
  1 27 authorizations, or approvals necessary for the subdivision and
  1 28 partitioning of, or construction on, any land located in the
  1 29 unincorporated areas of the county.
  1 30    Sec. 3.  This Act, being deemed of immediate importance,
  1 31 takes effect upon enactment.  
  1 32                           EXPLANATION
  1 33    This bill imposes a moratorium on annexation by a city.
  1 34 The moratorium also applies to annexation agreements between
  1 35 cities.  The moratorium is in place from the effective date of
  2  1 this bill until final adjournment of the year 2000 regular
  2  2 session of the Seventy-eighth General Assembly.
  2  3    The bill also imposes a moratorium on counties prohibiting
  2  4 them from issuing any permits, authorizations, or approvals
  2  5 necessary for subdividing or partitioning land, or
  2  6 constructing new buildings or structures on land located in
  2  7 the unincorporated areas of the county.  The moratorium on
  2  8 counties does not apply to reconstruction or rehabilitation of
  2  9 existing buildings or structures and it does not apply to new
  2 10 construction, reconstruction, or rehabilitation of
  2 11 agricultural buildings or structures.  The moratorium is in
  2 12 place from the effective date of this bill until final
  2 13 adjournment of the year 2000 regular session of the Seventy-
  2 14 eighth General Assembly.
  2 15    The bill takes effect upon enactment.
